Monies directed
to be paid into
hands of paymaster.
How to be appointed. |
47. AND BE IT ENACTED, That all money hereby
directed to be
paid into the hands of the paymasters of the several regiments or
extra battalions, shall be appropriated to the use of the respective
regiments or extra battalions in the following manner, to wit: In
the first place, to defray the necessary expenses of the regiment or
extra battalion, and of the several companies composing the same,
and after such necessary expenses are discharged, then the balance
to be applied by the field-officers of the respective regiments or extra
battalions, to the purchase of muskets and accoutrements necessary
thereto, which, when purchased, shall be distributed by the
said field-officers among such persons in their respective regiments
and extra battalions as are adjudged to be too indigent to purchase
the same at their own expense; which said money in the hands of
the said paymasters, shall only be drawn therefrom by an order or
orders in writing, under the hand of the field-officers of the regiment,
or any two of them, or under the hands of the major and two
captains of an extra battalion, specifying the purpose of which the
same is drawn. |
Commanders of
regiments, &c.
may establish
places of deposit
for arms, &c. |
48. AND BE IT ENACTED, That the commandments
of regiments,
extra battalions, and independent corps, are hereby authorised to
establish within their several districts some secure place of deposit
for the arms and accoutrements belonging to said regiment, extra
battalion or independent corps, and they are empowered, if they
shall deem it necessary and proper, to order each commandant of a
company within their district, to return their arms and accoutrements
to such place of deposit after each and every parade; and they
the said commandants of regiments, extra battalions and independent
corps, are hereby required, under a penalty of fifty dollars,
to employ some person to keep said arms and accoutrements in
good order, and arrange them in such a manner so that each commandant
of a company shall receive the same arms which are or
may be first held by such company; and said armourer, or person
so attending, shall be paid a reasonable sum for his services, out
of
the fines of the regiment, extra battalion, independent corps or
company, (as the case may be;) and all commandants of companies
who shall be ordered by their superior officer to deliver the arms
and accoutrements belonging to said company to such place of deposit
as by said officer shall be designated, are hereby required,
under a penalty not exceeding fifty dollars, at the discretion of a
court-martial, to comply with said order. |
Arms and accoutrements
shall
not be sold. |
49. AND BE IT ENACTED, That if any auctioneer,
constable, or
other person, shall sell any arms or accoutrements, where there is
reason to believe they are the property of the state, such person
shall, for every gun or the accoutrements of a militia-man thus sold,
forfeit the sum of ten dollars, to be recovered by any commissioned
officer under this act, in the same manner that other fines and forfeitures
are directed to be recovered under this act. |
Persons not wishing
to uniform to
be drilled. |
50. AND BE IT ENACTED, That the several commanding
officers
of companies in whose district a uniform company may be formed
agreeably to the provisions of this act, and where a number of persons
belonging to said district shall not wish to uniform themselves,
such commanding officers shall hereby be authorised to drill, or |
