to straighten, open and amend said road, having due regard, as far
as is practicable, in the whole course of said road, to shorten the
distance so as to do as little injury to private property as will comport
with public convenience, provided they do not lay the same
through the yard, garden or orchard, of any person or persons,
without his, her or their consent, nor more than thirty feet in width;
and when said commissioners, or any two of them, shall have so
laid out, straightened and amended said road, they shall execute,
sign and seal, a plain plot of the same, and return it to the justices
of the levy court of said county, who shall cause the same to be recorded
among the land records of said county; and the said commissioners,
or any two of them, shall have full power to contract
and bargain with any person or persons, over whose lands said
road may pass, or adjudge the damages any person may sustain by
said road, and make return of all contracts by them made, for land
or damages adjudged by them, by reason of opening, straightening
and amending said road, to the levy court of said county; and on
receiving the said plot of the road so laid out, and a return of said
contract or contracts, or for damages adjudged, the justices of said
levy court shall forthwith proceed to levy on the assessable property
of said county the necessary sum of money for defraying the
expense attending the opening, straightening and amending of said
road; and the said justices of the levy court shall appoint a supervisor
or supervisors for said road, in the same manner, and under
the same regulations, as other supervisors are appointed in said
county.

CHAP. 166.

    2.  AND BE IT ENACTED, That in case of the death of one or
more of the commissioners, by said justices appointed under this act,
they, the said justices of the levy court, shall appoint another person
or persons in his or their stead; and the said commissioners
shall receive two dollars for every day they act on the business of
said road.

An Act to make public an old Road in Harford County.  Lib. TH.

Passed Jan. 4, 1812.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That 
the surveyor of Harford county be, and he is hereby authorised and 
directed to lay out, survey, mark and bound, the old road in said
county, thirty feet in width, beginning at or near the north end of
Benjamin McCreery's field where the old road intersects the road
leading from Underhill's mill, to Patrick Smith's lane, pursuing
the old road by Thomas Street's, until it intersects the road leading
from William Slade's mill to Belle-Air, near James St. Clair's
bars, and return a plot of said road, when surveyed and laid out,
together with a certificate of the courses of the same, to the clerk
of said county, to be by him recorded.

    2.  AND BE IT ENACTED, That when a plot of said road shall
be returned and recorded as aforesaid, it shall and may be lawful
for the levy court of said county, to levy upon the assessable property
of said county, such sum of money as they shall deem necessary
under all circumstances, and appoint an overseer to open and
clear said road, agreeable to the plot and certificate aforesaid, who
shall give bond in like manner as other overseers of public roads
