            EDWARD LLOYD, ESQUIRE, GOVERNOR.

    3.  AND BE IT ENACTED, That the said commissioners, or the
majority of them, shall be and they are hereby authorised and required
to contract and agree for the building of the said gaol, and
to direct the plans of the same; which gaol shall be erected on the
public ground in Charles-town, commonly called Port Tobacco, in
Charles county, and when erected, finished and completed, shall
be used, held, taken and deemed to be the proper gaol of Charles
county.

    4.  AND BE IT ENACTED, That in case any of the said commissioners
shall die, remove, refuse or discontinue to act, the remaining
commissioners, or the majority of them, shall appoint one or
more persons, (as the case may be,) to fill up such vacancy.

    5.  AND BE IT ENACTED, That the said commissioners or the
majority of them, shall render a full and fair account to the levy
court of said county, of the receipts and expenditures of all monies
which shall be by them received and expended by virtue of
this act.

An Act to repeal the third section of an act, entitled, An act continuing
    an act relating to Costs in Criminal Cases.

    WHEREAS doubts exists whether the third section of the act
passed at November session, in the year seventeen hundred and
eighty-seven*, be now in force and operation or not; therefore,
Preamble.


*  Ch. 34.

   1.  BE IT ENACTED, by the General Assembly of Maryland, That 
the third section of an act passed at November session seventeen
hundred and eighty-seven, entitled, An act continuing the act relating
to costs in criminal cases, be and the same is hereby repealed
and declared to be null and void; Provided, that there shall be
deducted from such costs in every county, the same per centage as
may or shall be paid by the levy court of any county for collecting
the levy of said county.
