extend to Abraham Fuller, the benefit and relief of the act of assembly,
passed at November session eighteen hundred and five*,
entitled, An act for the relief of sundry insolvent debtors, and the
supplements thereto, without compelling him to produce the assent
of two thirds in amount, of his creditors, and to extend and afford
to the said Abraham Fuller, all the benefits, advantages and provisions
of the aforesaid act and the supplements thereto, in the same
manner, and upon the same terms and conditions, as if he had obtained
the assent of two thirds of his creditors, to his release under
the same.

    of Tobacco.

    BE IT ENACTED, by the General Assembly of Maryland, That
the fourth and fifth sections of an act, entitled, A supplement to the
act †, entitled, An act to regulate the inspection of tobacco, passed
at November session eighteen hundred and two ‡, be and the same
are hereby repealed.

                                  CHAP. XXXVIII.
An Act to lay out and make public a Road in Baltimore County.  Lib.
                                  TH. No. 3, fol. 57.

Passed Dec. 27.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That
Hezekiah Price, Peter Bond, Jacob Stansbury, John Daugherty
and Joshua Gorsuch, be and they are hereby appointed commissioners,
and they or a majority of them, are hereby authorised, at
the expense of the petitioners or any person who may think proper
to contribute thereto, to survey, lay off and make public, a road
fifty feet wide, beginning at the intersection of North and Bridge-street,
and running until it intersects Britain-street; and the said
road when so laid out, and a plot thereof made out and returned
to the clerk of Baltimore county court, shall for ever thereafter be
deemed a public highway, and kept in repair as other public roads
in said county are.

    2.  AND BE IT ENACTED, That the said commissioners, or a
majority of them, shall ascertain and value what damages may be
sustained by any person or persons through whose ground the said
road shall pass, taking into consideration the advantages and disadvantages,
if any; and the same, when so assessed, shall be paid
or secured to be paid by the person or persons who may apply to
have the said road laid out and made public as aforesaid, to the
person or persons entitled to receive the same, before he or they
shall proceed to condemn the said road.
To ascertain damages.
    3.  AND BE IT ENACTED, That if any person or persons through
whose ground the said road shall pass, or his, her or their guardian
or trustee, shall conceive himself, herself or themselves aggrieved
by such valuation and assessment of damages, it shall and
may be lawful for any justice of the peace on his, her or their application,
to issue his warrant under his hand and seal, directed to
the sheriff of said county, commanding him to summon twelve disinterested
men, qualified by law to serve as jurors in the county
court, to meet upon the premises on a certain day, of which six
days notice at least shall be given to the party or parties interested;
