CHAP. 30.

                                LAWS OF MARYLAND.

they are hereby authorised to apply to some justice of the peace for
said county, who shall thereupon issue his warrant, directed to the
constable of the hundred where the land lies, commanding him to
summon five substantial freeholders, not related to the said petitioners,
or any way interested, to be and appear on the premises, on a
day to be therein expressed; which said freeholders, upon their
oaths, to be administered by some justice of the peace, shall inquire
and ascertain what damages said William Amos, Joshua Amos and
Aquila Amos, have sustained by reason of the said road having been
located and opened through their lands; and the said freeholders
are hereby required to consider the convenience, benefit, advantages
and disadvantages occasioned by opening said road; and the constable
shall return the verdict of said jury, or of the majority of
them, under their hands and seals, to the levy court of Harford
county; and if such jury shall not award a larger sum of money for
damages sustained as aforesaid, than has already been allowed by
the commissioners appointed to ascertain the damages, the said
William Amos, Joshua Amos and Aquila Amos, shall pay the costs
of such inquiry; but in case the same shall exceed the sum allowed
by the said commissioners, then the said costs shall be levied on the
assessable property of said county, together with such further allowance
as shall be made by said jury to the said William Amos,
Joshua Amos and Aquila Amos, by the levy court of said county,
and be collected and paid as other public monies are levied, collected
and paid.

                                          CHAP. XXXI.
An Act to authorise the Levy Court of Cecil County to open a Road
    from the Presbyterian Meeting-House in West Nottingham, to Creswell's
    Ferry.

Preamble.     WHEREAS it is represented to this general assembly, by the petition
of sundry inhabitants of Cecil county, that the road from the
Presbyterian meeting-house in West Nottingham, to Creswell's
ferry, is very circuitous, and almost impassable for loaded wagons,
and that the convenience of the public would be greatly promoted
by laying out the same to run along, or near where a private
road now runs through the lands of the Reverend James Magraw,
Abner Coulson, Amos Erving, Henry Broughton, Alexander Nesbitt,
Robert McMaster, George Kidd, John Patterson, Samuel Gay,
jun. and Thomas Patton, until it intersects the public road leading
from the Brick meeting-house to Creswell's ferry, below the said
Samuel Gay's; therefore,
Levy court to appoint
commissioners
to lay out road.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That
the levy court of Cecil county are hereby authorised and empowered
to appoint three commissioners to view said ground, and lay
out a road not exceeding thirty feet in width, along or near the
private road aforesaid.

    2.  AND BE IT ENACTED, That the commissioners aforesaid shall
have the said road surveyed, and shall have power to bargain and
contract with any person or persons through whose land the said
road may pass, or to adjudge the damages any person may sustain
by the same, and make a return of all contracts by them made for
land or damages adjudged by them, by reason of opening said road;
and shall return the same, with a plot of said road, under their
