                                LAWS OF MARYLAND.

                                        CHAP. CXXIV.
An Act authorising a Lottery to raise a sum of Money for the purpose
    of making a permanent bridge over the River Monocacy in Frederick
    County.

Scheme may be
proposed—bond to
be given.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That
it shall and may be lawful for Henry Williams, Thomas Jones,
Abraham Hebling, Joseph S. Smith, Upton S. Reid, Joseph Taney,
John Crabster, Lewis Motter, Philip Nunamaker, Patrick Reid,
George Troxal, John Grabel, Henry Spalding and Nicholas Umstead,
or a majority of them, to propose a scheme or schemes of a
lottery or lotteries to raise a sum of money not exceeding ten thousand
dollars, clear of all expenses incurred in drawing the said
lottery, and to sell and dispose of the tickets thereof, and to draw
the same; provided, that the said Henry Williams, Thomas Jones,
Abraham Hebling, Joseph S. Smith, Upton S. Reid, Joseph Taney,
John Crabster, Lewis Motter, Philip Nunamaker, Patrick
Reid, George Troxal, John Grabel, Henry Spalding and Nicholas
Umstead, or a majority of them that undertake to act under this
law, before the sale or disposal of any ticket or tickets in said lottery,
give their bond to the state of Maryland, in the penalty of
twenty thousand dollars, conditioned that they will well and truly
apply so much money arising therefrom, within six months after the
drawing the said lottery be completed, as will satisfy the fortunate
adventurers for prizes drawn by them, and shall, within twelve
months after the drawing of the said lottery is completed, apply
the money raised by such lottery for the purpose of making a permanent
bridge over the river Monocacy, on or near the road leading
from Emmitsburg to Taney-town, at Carol's fording on said
river.
Bond to be lodged
in clerk's office.
    2.  AND BE IT ENACTED, That it shall be the duty of the said
managers, before they act as such, to lodge the bond entered into
as aforesaid in the office of the clerk of Frederick county, there to
be recorded, and upon such bond, or any office copy thereof, suit or
suits may be instituted against the obligors therein, or any of
them, or their legal representatives, for any breach or noncompliance
with the conditions of the same.
Authorised to sell
tickets in any part
of the state.

 
 

Proviso.

    3.  AND BE IT ENACTED, That the said managers be and they,
or any person or persons appointed by them, are hereby authorised
to dispose of and sell all or any of the tickets of said lottery in
the city of Baltimore, or any part of this state, any by-law or ordinance
of the corporation of the said city of Baltimore, to the
contrary thereof in any wise notwithstanding; Provided always,
that the commissioners herein before named shall not proceed to
sell any ticket or tickets in the aforesaid lottery or lotteries, until
the expiration of one year from the passage of this law, unless the
legislature of the state of Pennsylvania shall in the mean-time, by
a law of that state, authorise the selling of tickets in said lottery
or lotteries within that state.
