5. AND BE IT ENACTED, That the said commissioners,

majority of them, shall render a full and fair account to the levy
court of said county, of the receipts and expenditures of all money
by them received and expended in virtue of this act. |

Preamble. |
WHEREAS some of the managers appointed in the law
to which
this is a supplement have refused to act, by which means said law
cannot be carried into full force; therefore, |

2. BE IT ENACTED, by the General Assembly
of Maryland, That
James Earle, junior, Thomas P. Smith, John Bennett, Joseph
Haskins and William Clerk, or a majority of them, be and they
are hereby authorised and empowered to carry into full force and
effect a law passed at November session, eighteen hundred and
three, entitled, An act authorising a lottery to raise a sum of money
to purchase a fire-engine, and erect pumps in the town of Easton,
in Talbot county. |
Power vested in
former managers
made null and
void. |
3. AND BE IT ENACTED, That all power and authority
heretofore
vested in the managers of the law to which this is a supplement,
be and the same is hereby made null and void. |

CHAP. XCV.
An Act to prevent Nuisance in the neighbourhood of Fisheries on
the
River Susquehanna and at the Head of the Chesapeake
Bay. Lib.

Preamble. |
WHEREAS it is represented to this general assembly,
that persons
owning fisheries situate on the river Susquehanna, and at the
head of the Chesapeake Bay, neglect, at the end of the fishing
season, to remove the pickle, cleanse the vessels used in curing
fish, and suffer great quantities of fish to remain on the shore,
which becoming putrid incommode and endanger the health of the
neighbourhood; therefore, |

2. BE IT ENACTED, by the General Assembly
of Maryland, That
if any person or persons using fisheries or a fishery on the west
side of the river Susquehanna, shall for the space of ten days after
the expiration of the fishing season, neglect to remove any
putrifying pickle from the fishing shores, and cleanse the vessels
used in curing fish, or suffer quantities of fish to remain and
putrify on the fishing shores, any person thus offending shall forfeit,
on proof thereof being made, for the first offence five dollars,
and shall immediately remove such putrid fish and pickle, and
cleanse the vessels used in curing the fish, and on refusal or neglect
so to do for the space of five days thereafter, and proof thereof
being made, shall forfeit and pay a sum not exceeding twenty
dollars for every such offence. |
How to be recovered. |
3. AND BE IT ENACTED, That all fines and forfeitures
incurred
under this act shall be recovered as small debts are recoverable before |
