Their: Maties. Somerset County Ssc. The Jurors for their Maties at a Grand Jury held for
agt. the body of this County the second tuesday in March last past being sworn
Wm: Mason. upon the holy Evangelists: do present and find William: Mason of this County
- - - - - - - - togeather with one James: Inglish upon the fourteenth day of ffebry Ano. Dom
1690/1 did upon a point known by the name of Samphire point in Manokin
River within the Jurisdiction of this Court: Steal, kill and felloniously carry away four hoggs belonging
and of the propper marke of Elinor Cane Widdow, of the value of nine hundred and ninety nine pounds
of tobacco, being not only a great damage, detriment and injury to the sd Elinor but also to the good people
of this Province. Notwithstanding of the sacred and divine Law of God expressed in the eight Comandement
in these words (thou shalt not steal.) and in Contempt of the good Laws and institutions of this their Maties
Province
thereby dishonouring God. giving scandall and evill example to all the good people of this Province, and against
the publick peace. Therefore their Maties Attorney Craves judgment may be entered agt the sd Wm: Mason
and that he Suffer the pains and punishments by law in the Case made and provided. agt Such offenders &c.
James: Sangster. Clk. Indts.
The Indictment being Read, to wch. ye sd Mason pleaded not guilty, and for tryal put himself upn y Country
whereupon Command was given to the Sheriffe to Sumon twelve good and lawfull men of his vicenage
that

the matter might be the better understood, which was imediatly performed a list or pannel returned in Court
whose
names are as followeth. viz) John: Emmett. John: Smock. Wm: Henderson. Wm: Denson. Wm: Noble. Miles:
Gray
Edward: Evins. Henry: Hudson. Senior. Bryan: Peart. Thomas: Tull. James: Langrel. Aaron: Bishop. who being
duely summoned and Sworn. haveing heard the foresd Indictmt. read, as also these eight Evidences following
examined and Sworn in Open Court whose names are. viz Richard: Davis Thomas: Royall. Jno. Royall --
James. Terril. John: Bozman. John: Renshaw. John: Johnson. Paskew: Bartlett. who having recd their charge
are Sent forth to determine the matter. - - - - And being now returned in Court. being unanimously agreed
the plt & deft being called. do give in this following verdict. (viz) We of the Jury find the defendt
guilty of the Indictment. Jno. Emmett: foreman which verdict as aforesd was Ordered to be entered.

Ordered by this Court that the sd Wm: Mason. pay fourteen hundred thirty five pounds of tobacco to
Elinor
Cane it being the one halfe of the fourfold. Order likewise the sd Mason find good Security for his good
behaviour dureing Courts pleasure -------- Whereupon came the sd Wm: Mason. with his two Securityes. viz
Poke William
Robert^and Thomas: Ryoll and the sd Poke by Recognizance did become bound to their Maties in the sum of
Tenn pounds sterling money of England, the sd Poke, and Ryoll in the sum of five pounds like money, due
to be leavyed upon their goods and Chattels, Lands & Tennements for their Maties uses &c. - - - - - - - - - -
The Condition of this Recognizance is Such, that if the above bound Wm: Mason be of the good behaviour &
abearance to all their Maties Liege people of this Province dureing the Courts pleasure as also pay Court Charge
that then this Recognizance to be void and of none effect otherwayes to be and remain in full power force & virtue

To the worshipfull ye Comissioners of Somerset County in Court Sitting the humb Petition of James:Langrell
Whereas your Petitioner was fined for not appearing yesterday on the Jury being Legally Sumoned by the
sheriffe
Came presently after they were sworn, your Petitioner humbly craves that his fine may be remitted, being here
ready
this Day to attend your worps as in duty bound shall pray. &c.
Petition Granted.
