At at a Court held by their Maties Justices viz.
mr. ffrancis Jenckins. majr. Robert: King mr. James Dashiels.mr Thomas Newbold.

Their Maties. Somerset County Ssc. The Jurors for their maties at a Grand Jury held
----agt.----- for the body of this County the second tuesday in March last past being
James: Inglish Sworn upon the holy Evangelists. do present and find that James
Inglish
- - - - - - - - of this County Plantor, togeather with one Wm:Mason upon the
fourteenth
day. of ffebr. Anno: Domy 1690/1. did upon a point known by the name
of
Samphier point in Monokin River within the Jurisdiction of this Court, steal
kill
And carry away four hoggs belonging to and of the proper marke of Elinor.Cane widdow of the value of nine
hundred ninety and nine pounds of tobacco being not only a great damage, detriment and injury to the sd Elinor
but
also to all the good people of this Province. Notwithstanding of the sacred and divine Law of God expressed in the
eight Comandement, in these positive words, thou shalt not steal. and in Contempt of the good laws and
institutions
of this their Maties Province, thereby dishonouring Almighty God, giving scandall and evil Example to all the
good people of this Province, and agt the publick peace. Therefore their Maties Attorney craves judgment may
be entered agt the sd James: Inglish, and that he suffer the pains and punishments inflicted by law in that Case

made and provided. agt Such offenders. &c. Jno. Sangster. Clk. Indts.

The Indictment being Read to which the said James: Inglish pleaded not guilty and for his tryall
put himself upon the Country ------- And therefore Comand was given to the sheriffe to Summon twelve
good and lawfull men of this viconage that the matter might be the better understood. whereupon came
John: Emmett. John: Smock. Wm: Henderson. Wm: Denson. Wm: Noble. Miles: Gray Edward: Evins. Hen:
Hudson
sent. Bryan: Peart Thomas: Tull. James: Langrell. Aaron: Bishop. 12. who being duely returned impaneld
and Sworn, having deliberately heard the Indictmt as also the Oaths of these nine evidences fairly ~
examined & sworn viz Richard: Davies. Thomas: Royall. John:Royall. James Terril, Anne: Mason. John
Bozman. John: Renshaw. John: Johnson. Paskew: Bartlett. and having recd their charge are Sent forth
to determine the same . --------- which foresd Jury being now returned in Court being unanimously
agreed, do returne this following verdict. the Deft being called, is Ordered to be read. as followeth
(viz) we of the Jury find the defendant guilty of the Indictment. John: Emmett foreman
which verdict was as above, by this Court Ordrd to be entered.
The Courts judgment thereon was Ordered. that the deft James English pay to Elinor Cane the half
of the four fold. viz. fourteen hundred thirty five pounds of tobacco. and also Ordered the sd English
tenn lashes at the whipping post upon his bare back to be well laid on.. as also that he the sd Inglish
give good Security for his good behaviour dureing the Courts pleasure C Whereupon came the sd Inglish
* with his two securities (viz) Thomas: Carey & John: Johnson. And the sd Inglish did by Recognizance in
Open Court confess him Self to be indebted to their Maties in the Sum of tenn pounds Sterling money of England
the sd Carey and Johnson in five pounds like money apiece to be leavied on their good and Chattels Lands
and Tennements for their Maties uses &c. ---- The Condicon of which Recogniza is such yt if the above bonded
James: Inglish be of the good behavior and abearance to all their Maties Liege people of this Province dureing
the Courts pleasure As also pay Court Charges then the Recogniz void, else to remaine in full force and virture.
