March the 10th. 1690/1 ( 70 ) To their Maties Comissioners now sitting in Court The humble Petition of Jno. Starret of Pocomoke Humbly sheweth to your worps that the County path leading from Rehobeth Town to Nusswadox Bridge is very prejuditiall to the Petioner it being the best of the Land belonging to y Plantation which the Petioner enjoys and hath no Land fitt for produceing bread to his family within the Said Plantation, but only said Land through which sd path leads. Now so it is that the Petioner can clear A new path in a more convenient place of ground for the County, and in three miles a full halfe mile ~ nearer and better path if permitted by your worships. May it therefore please your worships to give Order that Some of the Neighbourhood may view the Said path intending to be made and upon finding the ground to be so qualified for a path as the Petioner Setts forth to Order the Petioner to clear the same, and he as in duty bound shall pray &c. The above sd Petion being Considered by this Court is granted, provided the sd Land be Quallified and sd Road cleared upon the propper Cost of the sd Jno. David Browne. mr. ffrancis:Jenckins. Capt. John: Winder. mr. Samll.Hopkins Capt. Jno. King Thomas: Midleton. Plt. Somerset County Ssc. John: Poplewell was attached to answer agt. unto Thomas: Midleton of the County of Accomack in Virgia John: Poplewell. Deft. in an action upon the Case . - - - - - - - - - - - - - - - - - - - - - - - - - And whereupon the plt by James:Sangster his Attorney Comes and sayes, that the deft is and stands indebted unto the plt in the full and just Sum of fourteen hundred and twelve pounds of tobacco as doth and may appear by account here in Court produced, which said Sum the deft did faithfully assume and promise to satisfie the plt but the sd defendt not regarding his said assumption, fraudulently and craftily intending to deceive the plt of the foresd Sum of 1412lb. of tobacco hath the same denyed and yet doth deny to the plts great losse & damage to the value of 2824lb. of tobacco, and hereupon brings this suite. Doe Dent for Deft.~ Rich: Roe Then was this following paper produced in Court pr mr Peter: Dent Attorney for the deft.~ - - - - I the Subscriber did pay to mr Wm: Anderson by Order of mr Thomas.Midleton for the use of John Poplewell one thousand and five hundred pounds of tobacco. paid on the 20th.day of ffebruary 1681 this given under my hand this 4th. day of September 1690, and am ready to depose to the same. At the request of John: Poplewell I Subscriber doe Certifie that Some tobacco was paid me as above Certified but the just quantity or time I doe not well remember not having my book about me, to(day) Subscribeth.
