( 69 ) March the 10th. 1690/1 To the Worll their Maties Justices of the Peace for the County of Somerset the humble Petion of Richard Hill and Martha his wife. Thomas: Morris Planter and Mary his wife and of Eliz: Smith Ward to the said Thomas: Morris humbly sheweth. That whereas John: Vigerous of this County Chyrurgeon pretending to be the greatest Creditor to the Estate of Edward: Smith and Anne his wife, The ffather and Mother of your Petioner by which pretence the said Vigerous hath procured letters of Admrn and the sd Estate hath gott into his hands and thereupon hath Admrd Engrossing the whole to himself, so fraudulently and craftily intending to deceive your Petioners of their just due and right proportionably of the said Estate, by a most unjust and illegall accompt produced to your worps. And whereas it is manifest and can appear that your Petioners ffather in his life time was never craved any tobacco or other thing by the said Vigerous Exceeding 1500lb of tobacco or under which your Petioners ffather did allwayes deny to be the said Vigerous his due. So your Petioners humbly beggs, that your worps as you represent God in Justice would Consider the ffatherless and Motherless Orphants condition that are like to be so grossly and manifestly wronged by the said John:Vigerous, who will no wayes allow yr Petioners their just dues, and that your worps would examine the said Doctors unjust and false account agt the sd Estate by which he deteineth Seaventy six pound twelve shillings sterling money 4787: Pound of tobacco, Severall Hoggs, four hhds of tobacco by him Sold, (as also one Nigroe boy which is no part of the Estate but the propper goods of your Petioners. your said Petioners being allwayes willing to allow the sd John. what he can in reason and conscience make appear what is justly due to him out of the sd Estate, and your Petioners shall ever in duty as bound pray. Petion Read and Continued till June Court // Order Vigerous then appear Maryland Somerset County Ssc. Whereas Complaint is this day (to wit the 3d. day of ffebruary ano. Domi. 1690/1 made by Margertt the wife of Samuel: Collins, that at divers times they lost Certain fatt hoggs but more espetially about Sabbath day last they lost one fatt hogg, which they have strong presumption to beleeve to be Stollen and carryed away by some person or persons lately come into these parts, as by many shrewd & palpable Circumstances seems concurring thereto , And she the said Margret having in Suspition some psons as above sd hath therefore craved this warrant that Search may be made &c. These are therefore in their Maties Name to will and require as also strictly to charge and Command you John:Starrett Constable of Pocomoke hundred that imediatly at sight hereof you make diligent Search in all Such Suspitious places where the sd Porke may be found, as you shall be directed by the sd Samull Collins or Margerett his wife according to Law, and if found that you bring the same along with the party with whom its found, either before me or Some other of their Maties Justices of the Peace for this County, to be proceeeded agt as in Such cases provided by Act of Assembly And hereof you are not to fail as you will answer the Contrary &c. given under my hand and Seal this day and year above sd ffrancis: Jenckins ? Sealed. ----- To mr. Jno. Starrett Constable of Pocomoke hundred these Executed and nothing found pr me John: Starrett. But the sd Starrett Complaining to this Court of being abused by Richard Small and Honora his wife in the prosecution of his Office the Court Orders Process issue agt the sd Small & his wife to answer to their Maties. &c. |
