( 57 ) ffebruary. 13th. 1690/1 - - - - - - Simon. Perkins. Junior Plt. agt Thomas Winder of this County was attached to answer unto Simon Perkins Thomas: Winder Deft. ---- Junior in an action on the Case. - - - - - - - - - - - - - - - - - - And whereupon the plt by Edward Jones his Attorney comes and sayes that the aforesd Tho:Winder standeth indebted unto the sd Simon Perkins Junior in the sum of One thousand pounds of tobacco as will appear in Court by Evidence to prove the pts accot. but the deft denieth to make satisfaction to the plt of the sd Sum of 1000. Pounds of tobacco but fraudulently intending. the plt to deceive in the Sum of 1000:pounds of tobacco, but hath refused to pay, and still doth refuse although often thereunto required whereupon the plts saith he is damnified and hath losse to the value of 1600:Pounds of tobacco and hereupon brings his suit. pr Quer Edward Jones. The defendt by James Sangster his Attorney Comes and defends the force and injury and saieth that the defendt is nowayes indebted to the plt, nor never assumed to pay and article of the sd accot. and desires it may be enquired of the Court. Edward: Jones Also. } Then was this following accompt produced in Court. viz Thomas: Winder Dr. to Simon Perkins Junior in Tobacco October the 13th 1690 ---------------- For going to St. Joneses County and to the whorekills -----400 lb Evidences sworn for plt For takeing up one Mare & breaking & riding y sd Mare. --600 William: Venables & 1000 Joseph: Venables --- Errors Excepted by me Simon: Perkins The Court having considered the premisses, and finding no assumption made by the deft doe find no Cause of action . - - - - - - - - - - - - - - - - - - - - - - - - - - - Janry.13th:1690/91 John: Panter having attended five dayes at ye worll.Court in a Controversie between Tho: Hobbs plt and Thomas: Carey: deft. on behalfe of the plt craves your worps Order for attendance.
