ffebruary. 13th. 1690/1 ( 58 ) William: Seamore Plt. John: Strawbridge was attached to answer unto Wm: Seamore agt. of a plea of trespass upon the Case. John:Strawbridge Deft} And whereupon the sd Wm. by Peter Dent his Attorney - - - - - - - - - - - complaineth that whereas the said John. the 21th. day of October 1689. at Monokin within the Jurisdiction of this Court was indebted to the said William in the Sum of four hundred pounds of tobacco being for so much by the said John to the sd William assumed to be paid for the deft of one Richard Murrah. Nevertheless the said John his promise and assumption aforesd not regarding but minding and fraudulently intending the said William of the said Sum of tobacco to deceive, and defraud, the same to the sd Wm although often demanded haith not paid to the damage of the said William of 1000 Pounds of tobacco and thereof he brings his suite &c. Dent. Plegs. Jno. Doe Rich: Roe And the Deft Jno. Strawbridge appeareth for himself and defendeth the force & injury &c and saith that the declaracon filed by the said Seamore agt the deft is altogeather irronious and false, for that the said plt declareth that the deft the 12th. of 8ber: 1688. at Monokin was indebted to the the said plt in the sum of 400lb. of tobacco, the defendt saith he never was indebted to the plt one pound of tobacco, nor never did assume to pay any tobacco to the sd plt on the account of Richard:Murrah as is Set forth in the said declaracon, and further the deft saith that the said Seamore, nor any other for him never demanded any tobacco from the deft. whereupon the deft saith there is no tobacco due by him nor no assumption made nore none demanded by the sd Seamore. And therefore the deft demandeth and craveth judgmt of the sd declaration and his damages &c. pr qre Jno. Strawbridge. The Deft puts him Self upon the Court and the plt also Dent. ----------------- Mr. Edward: Jones was Sumond and Sworn in Court for ye plt. who being examined knew nothing of y matter This Court Orders a Non Suit agt the plt. John Colhoon Craves Order for attendance Six dayes in an accon between Isaac ffoxcroft plt and Joseph: Bowles. deft. in the behalf of the plt. Sworn in Court before me. Thomas: Jones. This Bill bindeth me Thomas Carey of the County of Somerset and Province of Maryland Cooper me my Heirs Execcutors Admrs to pay or cause to be paid and deliver unto Thomas :Hobbs of the same County aforesd his Heirs or Assigns the just and full sum of five hundred twenty two pounds of good and Sound merchantable leaf tob. and Caske to contein the same to be paid at some convenient place, where the said Hobbs shall require in the County and Province aforesd, at or upon the tenth day of October next ensueing the date hereof, as in wittness hereof I have hereunto Sett this 25th day of June 1687 his Thomas ?
