Henry Lynch of this County was attached agt to answer unto ffrancis Jenckins, Admr of the goods & Chattels Henry: Lynch. Mercht..Deft. of Samuel: Cooper late of this County deceased in action upon ye Case &c - - - - - - - - - - - - - - And where upon the plt by James:Sangster his Attorney Comes and Sayes that the sd deft is become and stands indebted unto the plt as Admr. of the said Estate in the full and just Sum of thirteen hundred and three pounds of tobacco, as also fourten shillings money sterling with four botles of Rum and four pound of Suger, lent by the said Cooper decd as doth more fully appear by accot. here in Court produced,the deft faithfully assumeing to pay the said tobacco in Spetie, and the money Rum and Suger in kind as received, but ye sd deft not regarding his said assumption but fraudulently intending to deceive the plt of the foresd Sums, the same hath hitherto denyed and yett doth deny to the plts great losse and damage to the value of 2606; Pounds of tobacco 1,.8s. Sterling money 8 botles of Rum and 8lb of Suger and thereupon brings this suite. Jno.
