( 53 ) ffebruary 12th. 1690/1 Thomas Clifton. Plt. Somerset County Ssc. Stephen Bernard of this County Planter was agt. attached to answer unto Thomas Clifton of the County & Province Stephen:Bernard Deft Cordweiner in a plea of debt . - - - - And whereupon the plt by James Sangster his Attorney Comes and Sayes that the deft the 24th day of March Annoq Domy 1689/90 became indebted unto the plt in the full and just Sum of of five hundred and twenty Six pounds of good sound Merchantable tobacco in Caske to be paid the tenth day of October next ensueing the day of the date of a Certain Instrument under the hand and seal of him the sd deft and of the day and year abovesd (which is here in Court produced) wherein the said deft, did bind and oblige himself to pay or cause to be paid to the plt his Heirs, Execcutors, Admrs or Assigns the abovesd Sum of 526lb. of tobacco, as by the sd Instrument more fully appears. But the said defendt fraudulently and craftily intending to deceive the plt of the same, hath hitherto denied and yet doth deny though thereunto often required to the plts great losse & damage to the value of One thousand fifty two pounds of tobacco and hereupon brings this suite Jno. Doe Sangster pr Quer pled de prsois. Rich: Roe. And the Defendant by Peter his Attorney saith that the Original writt of the plt was Sued forth before the said tenth day of October according to the tenour of the sd Bill and this he puts himselfe on the Court &c. Dent. No Bill in Court appearing besides the action Comenced before day of payment This Court Order a Non Suit agt the plt. Ambrose,Riggin hath tended nine and twenty dayes in the suite between Lawrence Crawford. plt and William: Matthews deft. and Craves Order for the same his Sworne before me John: King. Ambrose + Riggin marke Walter. Taylor. having attended in a Controversie depending in your worps Court between Lawrence:Crawford plt and William:Matthews deft. Seaventeen dayes desires Order of Court for attendance. Sworn in Open Court before me Thomas: Jones.
