ffebruary 11th. 1690/1 ( 38 ) re To the worll their Maties Justices of the Peace for the County of Somerset The humble Petion of Tho Larram Whereas your Petioner was a Jury man yesterday and was forced last night to go to mony for Quarters and could not come time enough this morning, your Petionr craves your worps would remitt the fine and your Petioner as in duty bound shall pray. - - - - - Petion. granted. - - - - - - - - - - - - - - - - - - Their Majesties Somerset Ss. The Jurors for their Maties at a Grand Jury held for the body agt of this County the second tuesday in 9ber last past being Sworn upon Thomas: Oxford. the holy Evangelists, doe present and find, That Thomas Oxford of Matta - - - - - - - - - - = pony hundred within the Jurisdiction of this Court Sometime in the month of October last past not having the fear of God before his eyes but instigated and asisted by the devil at the house of Stephen Page in the foresd hundred, did wickedly and shamefully allure Seduce & entice one Margeret Kenneday of this County Spinster with prophane ungodly & unchristian like words, and further proceeded to Scurrulous & unseemly actions extending his priveties to the said womans view, and finding that the sd Margeret was alone and none to relieve her and asist her did violently lay hands on her and throw her downe, and her body most insolentely and inhumanly abused and what in him the said Oxford did lye endearvoured to comit a Rape upon her body, until the sd Margeretts Shreeks and Cryes did bring some sound of a person unknown to the house to her assistance, whereupon the said Oxford was necessitated to desist from his premeditated and intended villany. Now their Maties Attorney Comes & Sayes that the sd Oxford being so wicked and Shameless as to violate both the laws of God and man abuseing his own body, and endeavouring a Rape upon the body of the said Margeret with shamefull & unlawfull lust, ought to Suffer the pains and punishments due to Such Offences, being taken in his obscene intended Act, Since the Law, Maxim: Intention punitor non Sequetur effectus, points at the very same Case in all its Circumstances Therefore craves judgmt may be entered agt ye sd Oxford according to law in that Casemade and provided Ja: Sangster Clk. Indtmts The above said Indictment being read in Court to which the sd Oxford pleaded not guilty and for his tryall put him Selfe upon the Country. whereon Comand was given to y Sheriffe to Sumon twelve good and lawfull men of his neighbourhood, that the matter in question might be the better understood and forthwith the Sheriffe made a retourn of his list or pannel of Jury men whose names are as followeth viz. Richard Chambers: Walter Taylor, John: Colhoon. John: Broughton. Matthew: Dorman William Smullen Thomas: Tull. Benjamin Deards. William:Planner Junior. John: Panther Michael: Williams Richard: Jefferson. who being legally Sumoned and Sworn, having heard the aforesd Indictment as also the Oaths of two Evidences. as also the examination of three Evidences, with two depositions herin engrossed. The Deposition of Margret Kennedy aged about twenty One years this Deponent saith that upon the 19th. day of October last past Came into the house of mr Stephen Page he and his wife being in Accamack Thomas Oxford, who brought in his hand a Bulls pizle, with which he struck the Deponent on her back he replying that no Master or dame that ever she had, did ever strike her with Such a weapon, and upon these words a youth -- the house asking the sd Oxford whether he had not a better pizle then that, the said Oxford answered that he had, and took out his private members before all the family then in the house saying look you Set yr hope it a better pizle, here is a fine thing, he the sd Oxford then laid violent hands on me the Deponent, threw me a Cross some chairs, then took me in his arms, and threw me upon mr Pages bed, there in Strugling with me he (broke) down the Curtains, got his hand doe what I could up my naked body, I crying to him to desist in his base actions telling him that I would acquaint mrs Page how he endeavared to defyle his bed, he replyed that if mrs Page was there he would pay her old C of in the like kind I then calling to Elizabeth Lawrence mr P(age) (his) |
