( 39 ) ffebruary 11th. 1690/1 his maid to aid in releasing me from the sd Oxford he replying with a bloody Oath if she came there he would Serve her the same Sauce, and bid her be contented her turn should be next, So after much striving & strugling with the said Oxford I released by self this the said Deponent Saith and further saith not. her mark The said Deponent made Oath before me to the truth of Margeret: Kennedy all above written this sd: day of December 1690 witness my hand. Hopkins - - - - - - - - The Deposition of Elizabeth Lawrence Aged twenty years saith that she was an eye and eare witness to every word and all and every the actions and Carriages of the said Thomas Oxford as is above written and declared by Margeret Kenneday only excepted the rude handling of her naked body, this the Deponent saith and farther saith not. her marke. This Deponent Sworn upon the holy Evangelist to the truth Elizabeth Lawrence of what next above written. this 2d. day of December 1690. before me. Samll. Hopkins The aforesaid Jury having deliberatly heard the totall proceedings, receiving their charge goes forth to determine the same. - - - - which foresd Jury to the Barr in Court is now retourned with their verdict which is read in the audience of the said Oxford as followeth Viz) Wee of the Jury fineth Thomas Oxford guilty of shewing his privy parts, and throwing Margeret: Kennedy upon a bed, and of thrusting his hand under her cloathes, and of pulling hair from her privy parts. Richard: Chambers foreman. - - - - - - - - - - - - Evidences Sworne in the abovesd action wer Margeret Kennedy & Eliz: Lawrence Verdict Ordered to be Evidences Examined were Wm: Stevenson. John: Pope. and John: Jones } Entered The verdict being entered as above. the Courts opinion was to fine the sd Thomas Oxford for his sd Offence fourty dayes work and tools with diet. as also give good security for his good behaviour. - - - - - whereupon Came the said Oxford and by recognizance did acknowledge himself to be indebted to their Maties. in the Sum of 20,. Sterling money of England, as also came his two Securities and did acknowlege them selves likewise indebted in the Sum of 10,. a peice to be leavied as above for their Maties uses &c. / Securities Jno. Jones & Peter Whaples ----- The Condition of which Recognizance is Such that if the said Thomas Oxford be of the good behaviour and abearance to all their Maties Liege people of this Province, dureing the Courts pleasure as also pay fine and Court charges, then the Recognizance voyd, otherwayes to be and remain, in full power, force and vertue. -----finis . - - - - - - - - - - - - - - - - - - - - - - - - - - - Their. Majesties The said Oxford alias Ocford being calld to the Barr in Court, having heard this agt. following Iindictmt Read to which he pleaded not guilty, and for his tryall put Thomas: Oxford. himself upon the Country. whereupon Comand was given to the sheriffe to Sumon - - - - - - - - - twelve good and lawfull men of his Balywick, that the matter in question might be the better understood. a List or pannel whereof are as followeth viz --- Turne Over to the Jury |
