( 35 ) Their Maties agt Thomas Banister } ffebruary 10th. 1690/1 - - - - - - - - - - - - Somerset County Ssc. The Jurors for their Maties being Sworn upon ye holy Evangelists at a Grand Jury held for ye body of this County the second tuesday in 9ber last past, doe present and find that Thomas Banister of this County Labourer being lawfully warned, and having Sufficient notice from Andrew Whittington Overseer of their Maties high wayes for that part of Monokin River. to attend the 29th day of 9ber last past in Order to clear and amend ye said high wayes, in pursuance of an Act of Assembly in that Case made, did willingly wittingly & willfully himself absent and prove delinquent, without any Colour of Lawfull excuse, but only in Contempt of the abovesd Act Therefore their Maties Attorney Craves judgmt may be entered agt the said delinquent according to law in that Case made and provided &c. Ja: Sangster. Clk Indts To which Indtmt. the sd Banister pleaded not quilty saying he was at that time in another mans Service, which excuse was not thought Sufficient. Their Maties agt Mary Flanakin ---- - - - - - - - - - - - - - - - - The Jurors for their Maties at a Grand Jury held for y body of this County ye Second tuesday in 9ber last past being Sworn upon the holy Evangelist, do present and find that Mary fflanakin Servant to Samll Jones of Mony hundred within the Jurisdiction of this Court, hath most wickedly Sinfully and Shamefully Committed fornication and born a Basterd Child, to the great dishonour of Allmighty God, Scandall and evill Example to all their Maties liege people, and agt the laws and Institutions of this Province. Their Maties Attorney craves judgmt may be entered agt the said Offender, according to law in that Case made and provided &c. James: Sangster Clk Indts To which Indtmt. ye sd Mary did in Open Court confest saying the ffather of her child was gone out of this Country. and for her Offence humbly beggd, corporal punishment might be remitted and a fine accepted. which being considered, the Court did fine y sd Mary 25:dayes worke & dyet with tools, to be paid at Damd Quarter. Sam: Jones did promise the Court to see the Said worke paid when demanded, with Court Charges Their Maties. agt Dennis: Druskell. Somerset County Ssc. The Jurors for their Maties being Sworn upon the holy Evangelist at a Grand Jury held for the body of this County the second tuesday in November last past, do present and find that Dennis: Druskell of this County Planter being lawfully warned and having suffitient notice from George Betts Overseer of their Maties high wayes for that part of Mony hundred,to attend and mend their Maties high wayes, according to the Act of Assembly in that case provided, did willingly and wittingly himself absent and prove delinquent , without any Colour of lawfull excuse, but in contempt of the sd Act, and therefore their Maties Attorney craves judgmt may be entered agt the sd delinquent according to Law &c. Ja. Sangster. Clk. Indts. The sd Dennis was fined two dayes work and Court Charges Their Maties Somerset County Ssc. The Jurors for their Maties being sworn upon the holy Evangelists at a Grand Jury agt held for the body of this County the second tuesday in 9ber last past do present and find that Thomas Roe of this Thomas: Roe County Planter, being lawfully warned and having suffitient notice from George Betts Overseer of their Maties high wayes for Mony hundred to attend and mend the sd high wayes, in pursuance of an Act of Assembly in that Case made, did willingly, wittingly & willfully him Self absent and therein prove delinquent, without any Colour of Lawfull excuse, but in Contempt of the said law therefore their Maties Attorney craves judgmt may be entered |
