ffebruary 10th. 1690/1 ( 34 ) Jury being retourned and called Over, who upon Examination are unanimously agreed, the verdict being delivered and read in the audience of the plt & deft. as followeth // viz) wee of the Jury finds for y plt Richard: Chambers foreman Which foregoing verdict was Ordered to be enterd. by all the Justices except mr James Round and mr. Samuel: Hopkins who Orders their dissent to be entered Coll. Brown not at the tryall To the worll. their Maties. Justices of the Peace for this County of Somerset the Petion of Rich.Holland humbly sheweth whereas yr worps. petioner being Sumoned as an Evidence in a Certain matter of Controversie depending in your worp Court, between mr George Layfield plt agt Silas Chapman deft. for the plt your worps petionr attended eleaven dayes your petioner Craves your worps Ordr. for attendance and your petioner as in duty bound shall ever pray &c. Sworn before us Samuel: Hopkins: John: King. To the worll. Justices of Somerset County now in Court Sitting -------The humble Petion of George Benson humbly sheweth that yr petioner was Sumoned by the sheriffe to attend the Court on y behalfe of Peter: Whaples plt. agt Nicholas: Hartnel deft. on which your petioner attended six dayes for which your petioner Craves your worps. Ordr. and your petioner in duty bound shall pray Sworn to in Court before James: Round. The humble Petion of John: Parsons. To the worll. their Maties Justices of Somerset County in Court Sitting. most humbly sheweth that yr petioner the last November Came to Court to do his business and here was Sumoned for a Jury man your Petioner tended the Court 4 dayes and being in want did go to mr Whittingtons to refresh h imself, and before your petioner came to the Court was fined therefore yr. petioner humbly beggs of your Clemency to remitt ye fine.& ysr Petioner shall ever pray Petion Read was granted// paying fees --- as pr Ordr of Court To the worll. the Comrs of Somerset County The humble Petion of Robert Miller humbly sheweth unto your worps that your petioner understands that he is presented for not being helping to clear the high wayes, he not being at home when the same high wayes was a clearing. So it is may it please yr worps to remitt the said presentmt. yor petioner not being at home and withall being very ancient upwards to sixty years of age. may if therefore please your worps to discharge yr petioner from all publick servile work & likewise discharge the petioner from the Carrying of Arms &c. And as in duty bound your petioner shall ever pray &c. Petion Remitted. the sd Robert Miller promising to clear the Road from Capt. Coulborns plantation at Monokin, to the main Road att Major Robert Kings. - - - - - - - - - - - - - - - - - - - - - - - - - - - - Order upon the same This Indictmt. was read, which should properly have been engrossed before petion, order. Somerset County Ssc. The Jurors for their Maties being sworn upon the holy Evangelists at a Grand Jury held for body of this County the second tuesday in 9ber last past do present and find that Robert:Miller of this County Planter being lawfully warned and having Suffitient notice from Andrew:Whittington One of their Maties.Overseers of the high wayes for Monokin hundred to attend the sd high wayes the 29th. of 9ber last past in Order to clear and amend them in pursuance of an Act of Assembly in that Case made, he the sd Miller did willingly wittingly & wilfully himselfe absent and prove delinquent without any Colour of lawfull excuse but in Contempt of their Maties Good laws. Therefore their Maties Attorney Craves judgment may be entered agt the sd delinquent according to Law in that Case made and provided &c. July Crt. 1690/1 Ja. Sangster Clk. Indts. |
