8ber primo 1691 ( 168 ) - - - - - - - - - - - - with her furniture hath not complyed with the Condition of the sd Bond, but the said Boat hath keeped and defamed whereby the sd Bond of 2000lb of tobacco is become due to the plt as if it had no Conditon at all, and therefore Craves Order for the sd Sum with Costs and damages and hereupon brings this Suit &c. Doe Rich: Roe And the defendt by Peter Dent his Attorney Comes & defends the force & Injury & Saith that the plt is not qualified in Law to Sue or implead the Deft. Neither did the sd William: Cheesman Deft ever Seal Sign or diliver any. Obligation to the said ffrancis Roberts. or to the sd Richard. Lamb, as the plt in his Decl. hath averred and this he prayes may be enquired of by the Country. Dent pr Dft. This Bill bindeth me William Coulbourne of Animessex in the County abovesd Esqr. my Heirs, Extors Admrs or Assigns to pay unto Samuel: Alexander of Animessex in the sd County or his Orders, the full Sum of eleaven hundred pounds of good Sound Merchantable tobacco in Caske upon demand according to Act of Assembly as witness my hand and Seal. this 11th. of January 1687/8. William: Coulbourne. ? Sealed Witness present Charles Hall. The above sd Bill proved to be justly due by the Oath of Samll. Alexander in Court Robert. Coulbourne Capt William: Coulbourne Admr to abovesd Coulborne Confest judgmt to ye debt of 1100 lb. Coll. William: Coulbourne Deptr. 7br. ye 13th. 1688. Judith Downe the wife of Robert Downe of this County Planter Contra was by vertue of a Warrant directed from Capt. Winder, One of their Maties Judith: Downe Justices of the Peace, bearing date the 25th of Septembr 1691. attached & in Custody put into the hands of the high sheriffe of this County viz. mr. Stephen. Luffe and - - - - - - - - - - - being for a Certain Crime Comitted by the sd Judith Downe & within the sd County in that she the sd Judith did upon the 17th. of September last past maliciously villanously & felloniously Sett fire to the house of Thomas: Gordon of Nanticoke hundred, and the same with all the goods & Chattels therein Contained to the value of Sixty thousand pounds of tobacco did therein Consume & destroy most wickedly & felloniously, not having any regard to the sacred Laws of God, the Laws & institutions of this Country & Province, or the public peace and weal. Their Maties Attorney Craves judgment may be entered agt the sd Judith according to Law in that Case made and provided. J.S. Clr Indts. The prisoner being at the Barr. the Indictmt. was Read to which She the sd Judith pleaded not guilty And therefore Comand was given by this Court to the Sheriffe of our sd County to Sumon a Grand Jury to Enquire further into y matter A List or pannel whereof as thus retourned their Names as followeth. viz Richard: Chambers.
