( 169 ) 8 ber prime 1691 - - - - - - - - - - - - Which foresd Grand Jury being legally Summoned and duely Sworne upon the holy Evangelists who likewise having heard the foresd Indictmt the examination of the sd Judith, as also the Oaths of John: Kemp. and Edward: Gold. who were legally Sumoned and Sworn for their Maties agt the sd Judith. receives their Charge & are Sent forth - - - - - - - - - And this day viz the 1st. day of 8ber 1691. The sd Jury being returned in Court being called Over by their Names, all being unanimously agreed, doe make returne as followeth viz Rot:Downe & Susan Wee of the Grand Jury find Ignoramus upon the within Indictmt. given in by or foreman. Langley. Sumd B Richard: Chambers - - - - Ordered By this Court that Judith Downe find good Security for her good behaviour & appearance at our next County Court to be holden the 2d. tuesday in November Anno Dom. 1691. to answer to their Maties &c Whereupon Came Robert: Downe husband to the sd Judith and did by Recognizance confess himself to be indebted to their Maties Wm: & Mary King & Queen of England &c the Sum of 60,. Sterling money of England. due to be Leavied on his goods and Chattels Lands and Tennements for their Maties uses &c. The Condition of which Recognizance is Such that if Judith the wife of Robert Downe be of be of the good behaviour and abearance to all their Maties Liege People of this Province, dureing this Courts pleasure as also make her personall appearance at our next County Court to answer to Such matters & things as shall be then & there Objected agt her that then the abovesd Recognizance to be void and of none effect otherwayes to be & remain in full power force and vertue. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Ordered Likewise that Robert Downe give good Security for his behavior & appearance next Court to answer to their Maties as abovesd of his wife. Ordrd. into Sheriffs Custody till Bound ~ Whereupon came the sd Robert Downe with his two Securities viz John: Richins and Edward Gold and ye Said Robert in Open Court did confess himself to be justly indebted to their Maties in the Sum of Sixty pounds Sterling money of England, and the sd Richins and Gold did likewise confess themselves indebted to their Maties in the Sum of thirty pounds a piece, all due to be leavied on their goods & Chattels Lands & tenemts for their Maties uses &c. The Condicon of the above said Recognizance is Such that if the said Robert Downe be of the good behaviour and abearance to all their Maties Liege people of this Province dureing the Courts pleasure, as also shall make his personall appearance at our Next County Court to be holden the Second tuesday in November there to answer to all such matters and things as shall be then & there objected agt him on behalf of their Maties, that then this Recog. to be void & of none effect otherwayes to be & remain in full force & vertue. - - - - - - - - - - - - - - good behavr & Ordered. Likewise that John: Kemp give Security for his ^ appearance next Court to answer to their Maties &c. Order likewise sheriffe keep the sd Kemp in Custody till Security given. - - - - - - - - - - - - - - - - - - - - - - - - Whereupon Came the sd Kemp & his two Securities viz Thomas Ackworth & Wm: Henderson & the sd Kemp did confess him Self pr Recogniz to be indebted to their Maties in the Sum of 20,.Sterling money of England, and the sd Ackworth and Henderson did likewise acknowledge them selves to be indebted to sd Maties the Sum of tenn pounds like money to be leavied on their goods & Chattels Lands & Tennements for their Maties uses &c. |
