Dr. Aug. 1st. 1690. lb tob. To your Assumption for John: Barker. ----------------- 700 To the Change of a Horse. - - - - - - - - - - 100 Summa = 800 Errors Excepted pr Thomas: Roberts. The probat of the abovesd Accompt was made by the Oath of the abovesd Tho: Roberts. in Open Court this 13th. day of June 1691. And thereupon this Court passeth judgment agt the sd Wm: Browne for 300lb. of tobacco wth. Cost of Suite. Robt. Perrie Sumd & sworn for the deft. Thomas: Roberts: Plt: Somerset County Ss. William: Browne of this County Mercct. was Contra: attached to answer unto Thomas: Roberts of the same County Planter William: Browne: Deft in an action upon the Case. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - And whereupon the plt by James:Sangster his Attorney Comes & Sayes that in the month of August last past. the deft became indebted unto the plt One good Suffitient Cow and her Calf, which sd Cow and Calf was due to the plt. from John: Barker and the sd Barker not having wherewith to pay the plt, did dispose of One Servant Woman to the deft in Order to Satisfie ye plt of One young Mare One Cow and her Calf and Seven hundred pounds of tobacco, which sd perticulers the deft did faithfully assume and promise to pay, and in pursuance of the same, the deft hath delivered the Mare to the plt. but denyeth to give the plt Security for the Cow and Calfe which is but Comon right Since ye plt was of the benifit last year and yet doth deny either to satisfie or give Security for the true payment & therefore brings this Suite &c. Ja. Sa. pr Quer. pled prsec. Thomas:: Lugg ordr & Rich: Rugg. Then was this following ^ receit produced, a paper. which was writt on both sides --- mr. George: Parker. Pay unto mr. Wm: Anderson or his order thirteen hundred and eighty pounds of tobacco and Caske being the ballance of your Bill due to me long Since faile not or else expect further trouble, for upon the payment of the money I am ready to give you good Security for Confirmation of your Land, which is all from yr friend as you use me No ber. 8th, C prrere William: Browne. 1690. & borro by your friend 1550 to Joseph Woodland I gave Credit one hundred & fifty by mr. Wm: Turvell. 1750 2900 the Ballance of the whole bill is 2900 Received of Wm: Browne full Satisfaction of all accounts from the begining of the world to this day being Seven hundred & fifty pounds of tobacco and Caske, and One Cow and a Calf being for the use of One Jno Barker being in full of all accounts due from me William: William. Browne, as wittness my hand by me recd this 12.ffeby ano 1690 his Michael: Howard Thomas Roberts made Oath in Open Court Thomas + Roberts Edward: EH Hamond that the Cow and Calf was justly due. this Court marke his mark grants Order for the Same.
