June ye. 13th 1691 ( 132 ) - - - - - - - - - - - Plea. And the deft Saith that the plt did not bring to the deft the full quantity of hides within the time of ye within mentioned Obligation, and thereupon putts himself upon the Court. Edward Jones. And the plt maintains ye declaration and Sayes that the deft hath not Complyed with ye Condition of ye Bond Ja: Sa: Then was this following Bond produced. viz. Somerset County Ss. Know all men by these prsents that I James: Smith of Somerset County Tanner for and in Consideration of a Cow and Calf recd this day of Capt. Wm: Coulborne of the County aforesaid, do acknoweldge my Self my Heirs Extors and Admrs to owe and stand indebted unto the sd Wm: Coulborne aforesd the full and just Sum or quantity of twelve hundred pounds of good Sound merchantable tobacco and Caske to be pd Conveniently in the Said County of Somerset to him the sd Capt. Coulborne, his Heirs Extors or Certain Attorney for the true performance whereof I bind me my Heirs, Extors & Admrs. Signed with my hand and Sealed with my Seal: dated this twentieth day of ffebruary Annoqs Dom. 1688/9. John I Smith ? Seal The Condition of this Obligation is Such that if the above bounden James: Smith do well truly and faithfully Tann for the above named Capt.William:Coulbourne, twelve hides of steer, bull or Cow hides and three deer skins, at or before One year be expired to be accompted from the date hereof well & Suffitiently tanned that then this Obligation to Stand void and of none effect, Otherwise to stand in full force power and vertue. The plt and deft being three times Called, the plt Contra not appearing by him Self or Attorney. besides no John: Kellam: Deft.--` declaracon fyled. this Court Orders a Non Suit agt ye plt Thomas: Roberts. Plt. Somerset County Ss. Wm: Browne of this Mert was attached to answer Contra: unto Thomas: Roberts of the same County Planter in an action upon ye Case William: Browne. Dft. And whereupon the plt by James:Sangster his Attorney comes and Sayes that ye - - - - - - - - - - - - - - - - - - - - deft is become and stands indebted unto the plt in the full and just Sum of Eight hundred pounds of good Sound Mertable tobacco in Caske as doth and may appear by account here unto anexed, which Sum the sd deft did faithfully to himself assume, and to the plt promise to pay when thereunto required, But the sd deft. Wm:Brown fraudulently and Craftily intending to deceive the plt of the sd Sum of Eight hundred pounds of tobacco, hath hitherto denyed, and yet doth deny to the plts great losse and damage to the value of |
