( 113 ) June ye. Their Maties Charles. Tindall being Comitted unto the sheriffs Custody last night, who being Contra. brought to the Barr in Court. this following information was read. Charles: Tindall Somerset County Ss. - The Information of Ja: Sangster, their maties Attorney - - - - - - - - - is that Charles: Tindall of this County Cordweiner, after Hue & Cry Issued agt Wm: Morris of Dividing Creeks, for an Escape from the Sheriffe of this County did Conceal the sd Morris, and him did not apprehend for their Maties that the sd prisoner might be brought to Condigne punshimt. ---- Ja. Sa: C. Indt. - - - - - - - - - Upon Examination of the sd Morris Charles Tindall concerning sd Morris. the sd Tindall did in Open Court confess that he did shake hands with the sd Morris after sd Hue & Cry was issued against the sd Morris. the sd Tindall pretending that he durst not Seize him, fearing he might have a pistol in his pockett. the said Tindall further sayeth that one Ralph: Doe, was present at the sd shaking hands with sd Morris. -------- - - - - - - - - - - - - - - - - - - - - - Ordered. by this Court that that Charles: Tindall give Security to the sheriffe to produce Wm: Morris at the next Court, to answer what should be Objected agt the sd Morris On their Maties behalf, or the sd Tindall to remain in the Sheriffs Custody. Ordered by this Court that Edmund: Munlavell. be fined according to rules of Court for Swearing as also that he give Security for his fine and good behaviour. ------ Edmd by Whereupon came the sd Edmund with his Security John: Strawbridge, and the sd ^ Recognizance did in Open Court confess him Self to owe and be indebted unto their Maties the sum of tenn pounds Sterling money of England, and the sd John: Strawbridge in like manner did confess him Self indebted the sum of five pounds like lawfull money of England, due to be leavied on their goods and Chattels lands and Tennements for their Maties uses &c. The Condition of the above the abovesd Recognizance is Such that if the above bound Edmund ~ Munlavell do pay his fine and Court Charges, as also be of the good behaviour, and abearance to all their Maties Liege People of this Province dureing the Courts pleasure that then this Recognizance to be void and of none effect, Otherwayes to be and remain in full power force and vertue ------ De Ck. Ordered by this Court that the Jury open tryall of Strawbridge and Jones be allowed their fees. Ord given pr Peter: Whaples: Plt. Somerset County Ss. James: Barry of this County: Tanner. was attached to answer agt unto Peter: Whaples. of the same County Cordweiner in a plea of debt. --------- James: Barry. Dft. And whereupon the plt by James: Sangster his Attorney Comes and sayes that the sd - - - - - - - - - - - - deft, is become and stands indebted unto the plt. his Heirs, Execcutors, Admrs.Assigns Or Lawfull Agent the full and just quantity of fifty Six good large Slaughter hides , whereof the one half is to be upper leather well tanned and Curried, and the Other half to be Sole leather payable at or before the last day of August next & immediate after the day of the date of a Certain Spetialty under the hand and Seal of the sd deft bearing date the first day of July Ano. Domi. 1689. and is here in Court produced, wherein the sd deft, did firmly bind himself his Heirs & Admrs for the payment of the sd hides. Notwithstanding of the sd Specialty the defendt fraudulently & Craftily intending to deceive the plt. the same hath denyed to pay, and yet doth deny to pay------------ |
