June 11th. 1691 ( 112 ) - - - - - - - The Deposition of Walter: Taylor Teague Riggen. Junior & Ambrose Riggen saith that they have attended the Court in a Certain Cause between Wm: Matthews. plt and mr Lawrence Crawford, Each of them as followeth - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Walter: Taylor: 5: dayes with Comeing and going June the 11th. 1691. Then Teague Rigen. Walter Teague. Riggen.19: dayes with Coming & going Taylor. & Ambrose Riggen Made Oath upon the holy Ambrose:Riggen 5 dayes with Coming & going Evangelists that they have duely attended as they have herein declared . Sworne before me. Order granted for the same ffra: Jenckins - - - - - - - - - - - - - - - - - - - - - - Their Maties Somerset County Ss. ffrancis Roberts of this County Planter Contra was Sumoned to answer unto their Maties what should be Francis: Roberts Objected agt him C And thereupon their Maties Attorney Comes and - - - - - - - - - - - - Sayes that the said Roberts, hath most wickedly, Sinfully & shamefully Comitted ffornication, and upon the body of Mary Mackennie hath begott a Basterd Child. agt the Laws of this Province. J.S. The said Mary Mackennie yesterday having made Oath in Open Court that ffr: Roberts now at the Barr was the ffather of her Basterd Child as in folio 95. Therefore the Court Orders the sd Roberts to give good Security for his behaviour, as also to keep the County harmless and indemnified from the sd Basterd Child And whereupon Came the sd ffrancis: Roberts with his two Securities (viz) James Langrell & Jno.Richins and the sd Roberts in Open Court pr Recognizance, did confess him Self to owe and be indebted unto their Maties in the sum of twenty pounds Sterling money of England and the sd Langrel & Richins in the sum of ten pounds a piece like lawfull money, due to be leavied on their goods and Chattels lands and tenements for their Maties uses &c The Condition of which Recognizance is Such that if the above bound ffrancis: Roberts be of the good behaviour and abeareance to all their Maties Liege people of this Province, and shall keep this County harmless and indemnified from charge or trouble by reason of a Basterd Child borne of the body of Mary Mackennie as also to pay all Court Charges then this Recognizance to be void. Otherwayes to be & remain in full power force and vertue. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Memorand.~ The said ffra. Roberts in Open Court agreed with the sd Mackennie to give her twelve hundred Pounds of tobacco to keep the forsd Basterd Child twelve months. - - - - - - - - - - - - - - - - - - - - - - - - Courts adjourned till tomorrow at 8. a Clock.
