June 11th 1691 ( 108 ) - - - - - - - - The Deposition of ffrancis: Heap, aged about thirty five years, this Deponent Saith that being at ye house of mr Ellis Coleman, he there saw Colonel: Brown and mr Brereton, to whom the said mr. Coleman and mr. Scarbrough did referr Some controversies and differences in accounts, to be decided by them. and the sd Coll. Brown & Brereton, did go forth, as I the Deponent understood, to end the said differences, and returned again, declaring that the differences was so small they could not declare of which side it was, So the said Coleman, and the said Scarbrough did declare that they were both fully Satisfied, with what Coll. Brown and mr. Brereton had done, which to the Deponents understanding, was a final end & conclusion of ye said differences between the sd Coll. & Scarbrough relating to their accounts, this the Deponent saith & further saith not. witness my hand this 7th. day of March 90/91 signum. Hopkins. // These Serve to Inform the worshipfull Court of Somerset County that I coming to the house of mr Ellis: Coleman. sometime about ffebruary last, did there meet with Coll. David: Brown. mr Wm: Brereton and mr. matt Scarbrough, and after some small Stay. Coll. Brown with mr. Wm: Brereton went out as I understood upon & Arbitration, about a difference between mr. Matthew:Scarbrough, and mr. Ellis Coleman, and after some Small stay they came in, and declared there was Some small difference, but the thing was so small that they ~ would not tell which side it was, to the truth of which I am ready to give my Oath when Opportunity Serves. as wittness my hand this 26th. day of ffebry 1690/1: James: Round These may Certifie that what abovesd is here signed by mr. James: Round is the truth of what was transacted at sd mr. Ellis Colemans house by mr. Wm: Brereton & David: Browne. The Court having rightly Considered the totall proceedings, do Ordr. a Non Suit agt the plt. Charles: Tindall. Plt. Somerset County Ss. Henry: Lynch of this County Mercht. was Sumoned Contra: to answer unto Charles:Tindall Cordweiner in a plea yt he render unto Henry: Lynch:Mercht. Deft. the plt, eight hundred pounds of tobacco which to him he oweth and - - - - - - - - - - - - - - unjustly deteineth. -------- And whereupon the plt lby James: Sangster his Attorney Comes and sayes. that the deft is become & stands indebted unto the plt in the full and just Sum of eight hundred Pounds of tobacco as doth and may appear by a certain writing under the hand of the said deft bearing date the 27th. day of Decemr. Anno. Domii 1688. wherein the sd deft Obligeth himself to pay upon sight of the sd writing the abovesd Sum of sd Sum of eight hundred pounds of tobacco but the sd defendt fraudulently and craftily intending to deceive the sum hath denyed and yet doth deny thou often theirunto required to the great losse and damage of the plt to the value of Sixteen hundred pounds of tobacco & hereupon brings this suite &c. Doe Rich: Roe And the deft saith he hath Satisfied the Sum of Six hundred and fifty Pounds of tobacco Part of the sd debt, and as to the sd Ballance of sd Bill, One hundred and fifty pounds of tobacco, ye sd deft hath tendred him satisfaction and this he prays may be enquired of by the Court.
