Richard: Webb. deft. by Edward Jones his attorny comes and defends the force and injury when and where, and saith that the deft, did not imploy the said Samuel. Cooper. to Survey any land for the deft, and thereupon puts himself upon the Court. pr Quer. Edward: Jones. Rich: Webb / Your accot. for Surveying - - - - - - Ja. Sangster. of your 200: ars of Land Comes to 230lb. tob. which I would have you pay mr ffrancis: Jenckins whose receit shall discharge you from. Your friend // Sam: Cooper. May the 26. 1684. Coleman late of this County Contra was attached to answer unto Matthew Scarbrough of a Plea Ellis: Coleman: Defendt of trespas upon the Case. &c. - - - - - - - - - - - - And whereupon the said Matthew by Peter: Dent his Attorney Complains that whereas the sd Ellis the 30th. day of June in the year of ur Lord 1689. at Snow hill within the Jurisdiction of this Court was indebted to the said Matthew in the Sum of four hundred and twenty pounds of Pork, for Sundry goods and merchandizes, by the said Matthew to the sd Ellis Sold and delivered, as by a perticuler account thereof here in Court ready to be produced may appear, and the sd Ellis to the said Matthew in manner aforesd being indebted, did assume upon him Self, and to the sd Matthew then and there faithfully promise that he the sd Ellis the sd 420: Pounds of Pork, when he should be thereunt requested would well and truly Content and pay. Nevertheless the sd Ellis his promise & Assumption afored not regarding but minding & fraudulently intending him the sd Matthew in this behalf to deceive and defraud the sd Sum of 240 Pounds of Pork to the said Matthew hath not paid although often demanded. but hath hitherto refused and doth still refuse to the damage of the said Matthew of 1600: Pounds of tobacco, and thereof he brings his suit &c. Dent pr Quer. / Plegs &c. Jno. Doe Rich: Roe Accounted before Auditors and nothing due to the plt saith the deft, and desires that it may be enquired of by the Court. Ja: Sa.
