June ye. 11th 1691 ( 106 ) - - - - - - - - - Wm: Matthews: Plt. Somerset County Ss. Contra: Lawrence: Crawford of this County Gent. was attached to answer unto Lawrence: Crawford Dft. Wm: Matthews in an action of the Case. ----- And whereupon the - - - - - - - - - - - - sd Wm. by his Attorney. Edward: Jones, saith that the deft about the month of 7ber in the year 1689 then did the plt did Agree with ye defendt. to gett in the Cypress timber for boards, whereupon the plt did gett Severall Cutts for the deft and saith that there is due to the plt. sixteen Cutts of the like Cypress in the Cypress swamp, where the plt did agree with the deft, the One half to the plt, and the other half to the deft. but the deft doth deny the plt leave to goe into the aforesd swamp to carry away the aforesd sixteen Cutts of Cypress timber that is due to ye plt, whereupon the plt saith he is damnified and hath losse to the value of One thousand pounds of tobacco and thereupon brings his Suit. pr. Quer Edward: Jones. E. The Deposition of Somerset Dickison Aged 28th. years or thereabouts, being Sworn upon the holy Evangelists saith as followeth. Wm: Matthews in August Court Last, called mr L Crawford out of ye Court house, and asked him if he would give him leave to take his timber out of the Cypress swamp and the said Crawford replyed he should not, and further saith not Being Sworn before us this 8th. day of Decemer 1690. ffrancis: Jenckins Teague Riggen Junior Edmund: Howard. Walter: Taylor & } sworn in Court for ye deft. Plt. Ambrose: Riggen The whole proceedings being left to the judgmt of this Court, do grant Order agt the sd Crawford for sixteen Cutts of Cypress timber. ---------- The said Crawford after judgmt passed agt him Craves an appeal which by this Court is granted But the next day following the sd Crawford came, and in Open Court, did desire that he might have Liberty to decline from his foresd appeal. which to him was granted --- Plea which should have been placed after Declaracon. The deft. by J: S his Attorney Comes and defends the force and injury and saith that the plt was to give a true and true account to the deft of what Timber he gott which the plt hath not done and utterly refuseth to doe, and likewise the plt hath taken away some timber without his knowledge and desires to know whether the plt ought not to give accot. to the deft before he carry away the remainder. J.S. - - - - - - - - - - - - - - - - - - - - - Mr. Francis: Jenkins. plt Somerset County Ss. Richard: Webb of this County: Planter was attached Contra to answer unto ffrancis of the same County Gent. Admr. of the goods and Richard. Webb. Defendt and Chattels of Samuel: Cooper late of this County decd in an action upon y Case - - - - - - - - - - - And whereupon the plt by James:Sangster his Attorney Comes and Sayes that The sd Deft Richard Webb, is and stands indebted unto the Estate of Samuel:Cooper deceased the full and just sum of two hundred fourty and two 2 pounds of tobacco of tobacco as doth and may appear by account here in Court produced which said sum was due unto the sd Cooper deceased and is now the right of the plt as Admr but the deft Since the decease of the said Cooper, fraudulently and Craftily intending to deceive the plt of the said Sum of 2422. Pounds of tobacco hath the same denyed, and yet doth deny to the plts great loss & damage to the value of 485 lb. of |
