( 101 ) June ye 10th. 1691 - - - - - - - - - And Confess himself to owe and be indebted unto their Maties in the sum of tenn pounds Sterling moneys of a piece England and the sd Lawrence Crawford and Teague Riggon like wise indebted to sd Maties in the sum of five pound of the like money, due to be leavied on their goods and Chattels Land and Tennements for their Maties. uses &c. --- The Condition of which Recognizance is Such that if the above bound Walter Taylor be of his good behaviour and abearance to all their Maties Liege People of this Province, but more espetially to mr Samuel. Hopkins of this County senr dureing the Courts pleasure, as also pay his fine and fees, that then this Recognizance to be void and of none effect. Rowell late of Somerset County was attached to answer unto Capt Henr: Smith of a plea of trespass upon the Case. &c. And whereupon the said Henry by Peter Dent his Attorney Completh Monokin wthin that whereas the sd Jno. the 20th day of October in the year of our Lord 1689. at ^the Jurisdiction of this Court was indebted unto the said Henry in the sum of five thousand pounds of tobacco being for One tract of Land Called Hudson ffolly and the sd John: to the sd Henry in manner aforesd being indebted did assume upon himself and to the said Henry faithfully promise that he the sd John the sd Sum of five thousand pounds of tobacco to the said Henry when he should be requested would well and truly Content and pay. Nevertheless the said John. his promise and assumption aforesd not regarding, but minding and fraudulently intending him the said Henry in this behalf Craftily and Subtily to deceive and defraud the said Sum of 5000 Pounds of tobacco to the sd Henry hath not paid although often demanded but hath hitherto refused, and doth still refuse to the damage of the sd Henry of 6000: Pounds of tobacco, and thereof he brings his suit &c. Samuel: Hopkins. mr. Thomas: Jones: Capt. John: King. --- Mr. ffrancis: Jenckins. plt Walter: Lane being called in Court before the tryall in hand twixt the sd agt. Jenckins, and him the sd Lane. the sd Lane told the Court he had nothing George Seaward:&Walter Lane deft to say in the matter nor would he be concerned as Execcutory to Seaward unless (Exto.s) to Jos. Seaward: deced~ the Court would please to grant him letters of Admrn soley in his own name - - - - - - - - - - - - - - - - - - - - Which being Considered by this Court, Letters of Admrs. is soly granted to the sd Lane. mr. Jenckins not on Bench and the tryall proceeded as followeth. Nota:Bene. whereas all the actions upon the Dockett wch were comenced agt Seaward and Lane, which sd Actions was withstood by Lane till the Admrs was soly granted to sd Lane which now the sd Lane accepts, the Court likewise approves of the sd Actions to be good and so the tryalls did proceed as here after is appearant.
