said Timber, that is now to be seen which will make no more then four, five or six boards a Piece a pattern of some
of which pieces is brought by the Deponents ffathers Order to the Court to be viewed if their worps pleaseth --
This the Deponent saith and further now he saith not. Samuel: Hopkins Junior. sworn to pr Deponent in Court

We the subscribers hereof being requested by Samuel: Hopkins Senr to inspect and view 74: pieces of Cypress
timber which timber the sd Hopkins as was sent him by Walter: Taylor or his Order, we do hereby Certifie &
make known unto all persons whom these presents doth or may concern, that we have cautiously,carefully & satisfyingly
viewed compared inspected, computed and calculated the said timber, and in having so done we do evidently find
and discover as followeth. ffirst. That all and wholy the sd timber is the product of very large or great trees
which hath made double Stuffe, that is to say heart breadth pieces of both kinds bigger and less. 2dly that four
of sundry of the said Sapp pieces is just answerable and equivalent to three other of the said Sapp pieces by which
tryal and discovery it is demonstrative enough that some Cutts hath been mauled after another manner or demention
and into more pieces that some other pieces Cutt or Cutts have been. 3ly. we do find by comparing suiting and
laying
together the sd biggest heart pieces, with the sd biggest of the sapp pieces. that one heart piece being laid to three
Sapp pieces they four do exactly match, and correspond in compleating the 8th. part of one Cutt of timber and no
more. Again we have laid the small sap pieces with the sd small heart pieces exactly comparing them togeather
and do plainly discover that two of the sd sap pieces is propperly belonging to one or each of every small heart
piece, which said three pieces do make one 16th of a Cutt and Six of the said small pieces do make on 8th of a Cut
and no more.
4thly. as a true result ariseing from the premises we the sd viewers do unamously conclude and will mentain that
each
cutt mauled after the manner of the biggest sort of pieces aforesd hath aforded and yielded 32: pieces in one Cut
again we do say and affirme that every cutt mauled according to the demensions of the said small pieces have
yielded
48 pieces in each Cutt.
Lastly upon our Considering weighing inspecting Computeing viewing & calculating the whole complement of the
abovesd 74: pieces of timber, we cannot in honesty, reason experience or conscience Apprehend or judge that
there is any more then two Cutts of timber and 2 Cutt allowing 32: of the sd pieces One with another biggest and
and smallest. to each Cutt which makes 64: pieces and the fraction 12: pieces over and above, the two Cutts being
added compleats the whole Complemente or number of 76. pieces of timber Sent as is afirmed by the said Walter
Taylor for 9: Cutts and one halfe to the truth of all above written, we the subscribers have sett to our hands this
ninth day of June 1691.
Sworn to in Open Court by Bryan: Peart. John: Smock & William Turvile.
And now the aforesaid Jury having deliberately had heard the Indictmt Depositions, and examination of
these eleaven Evidences who all made Oath in Open Court concerning the prmises, their names (viz)
Wm: Richardson. Wm: Turvile. Jno, Smock. Jno. Kellam. Bryan: Peart. Lawrence Crawford. Wm:
Henderson
Adam: Spence. Samuel: Hopkins Junior. Wm: Noble. and John a Servant to John: Outen who having recd
their
Charge are Sent forth to determine of the matter. ----- which foresd Jury being now returned are called
over being unanimously agreed to bring in this following verdict (viz) we of the Jury findeth
the defendant guilty of the Indictment. John: Emmett wch. verdict was pr Court Ordered to be entered
Likewise the said Walter was by order of Court fined four hundred pounds of tobacco. And Ordered to
find
good Security for his good behaviour, ---- Whereupon came the aforesaid Walter with his two Securities
viz
Lawrence Crawford and Teague Riggen. Junior. And the sd Walter. did pr Recognizance acknowledge
