Somerset County Ss. George Seaward and Walter: Lane Extrs of the last will and Testament of Josias Seaward
decd were attached to answer unto mr ffrancis Jenckins of a plea of trespass upon the Case &c. -------
And whereupon the said ffrancis by Peter: Dent his Attorney Complains that whereas the said Josias the 25th. day of
September in the year of our Lord 1689. within the Jurisdiction of this Court, in his life time, was indebted
to the said ffrancis in the sum of five thousand three hundred thirty Six pounds of tobacco as by a perticular account
here in Court may appear, and the said Josias to the said ffrancis in manner aforesd being indebted did assume
upon himself and to the said ffrancis faithfully promise that he the said Josias the said the sd Sum of tobacco
when he should be thereunto requested to the sd ffrancis would well and truly content and pay, Nevertheless the sd
Josias his promise and assumption afd not regarding but minding the sd ffrancis in this behalf to deceive the
said sum of tobacco to the sd ffrancis hath not paid nor the said George and Walter Extrs as aforesd nor any of
them hath not paid to the damage of the sd ffrancis of 7000: Pounds of toba. and thereof he bringeth his suit &c.
