such, shall take and subscribe, before the Clerk of
the Circuit Court of said county, the oath required
by the constitution of this State; and in case of the
death, resignation, removal from the county, or other
disqualification of the said commissioner, the Judges
of the Orphan's Court aforesaid shall fill the vacancy,
and the said commissioner shall receive such com-
pensation, not exceeding twenty dollars in each case,
as the County Commissioners of said county shall
allow, to be paid to him by the treasurer of said
county upon the order of said commissioners.
SEC. 3. And be it enacted, That the said commis-
sioner shall, at the expense of said county, provide
himself with a suitable book and such stationery and
blanks as may be required, and in said book he shall
keep a fair record of each and every ease brought
before him, and of all the papers, testimony and pro-
ceedings therein; and upon the completion of his
duties as commissioner, shall deposit said book in
the office of Register of Wills of said county, to be
kept as other record books therein.
SEC. 4. And be it enacted. That in every case, before
proceeding to take testimony therein, the said com-
missioner shall give at least ten days' notice of the
time and place appointed for the taking thereof, to
all persons interested therein, by advertisement in
one or more newspapers published in said county;
and where the persons interested are known to him,
and reside in said county, also by written or printed
notices, to be served upon them by the sheriff of said
comity; and any person interested shall have the
right to appear in person, or by attorney, before the
said commissioner, on the day appointed for taking
testimony, as aforesaid, to examine or cross-examine
"witnesses, as the case may be; and the said commis-
sioner shall have power to adjourn or continue his pro-
ceedings from time to time, as the ends of justice may
require, and he shall issue process for all witnesses
desired by any person or persons interested in any case.
SEC. 5. And be it enacted, That this Act shall take
effect from the date of its passage, and continue in
in force until the first day of June, in the year eigh-
teen hundred and seventy-three.
