CHAPTER 387.
AN ACT to repeal section four of an Act passed
by the General Assembly of Maryland, at its Janu-
ary session, eighteen hundred and seventy, chapter
ninety-nine, entitled "an Act to lay oft' streets in
Baltimore county adjoining Baltimore city," and
to repeal certain Acts inconsistent therewith, and
to re-enact the same with amendments.
SECTION 1. Be it enacted hi] the General Assembly of
Man/land, That section four of an Act passed by the
General Assembly of Maryland, at its January ses-
sion, eighteen hundred and seventy, chapter ninety-
nine, entitled " an Act to lay oft' streets in Baltimore
county adjoining Baltimore city, and to repeal cer-
tain Acts inconsistent therewith," be and the same
is hereby repealed, and re-enacted so as to read as
follows:
4. Whenever the said Street Commissioners shall
proceed to lay off, open or grade any street, avenue,
square or alley, in pursuance of this Act, or of any
supplement thereto, they filial], on oath or affirma-
tion, value and determine the damages and benefits
which any owner or owners over whose ground the
same may pass will receive thereby, taking into con-
sideration all advantages and disadvantages, and
also, considering, where the line, location or Led of
any private road, street or avenue is adopted, in
whole or in part, the reasonable cost of the same,
and allowing to the owner or owners of such private
road, street or avenue, such just sum by way of dam-
ages as may suffice to place the said owner or owners
upon equal footing with the other parties interested
and assessed; and the said Street Commissioners,
after having ascertained as aforesaid the whole
amount of said damages, and having added thereto
an estimate by them made of the probable cost of
construction of such street, square, avenue or alley,
shall assess the gross amount of such damages and
costs of construction, in such proportion as may be
fair and equitable, upon all the grounds and im-
