which no choice shall be made, a second election
shall be held, after not less than ten days' public
notice, and so on until a choice is had.
SEC. 7. And be it enacted. That the burgess and
commissioners shall each qualify as such before a
Justice of the Peace for Washington county, by
making oath that they will discharge the duties of
their respective offices according to the best of their
skill and judgment without fear, favor or partiality
to any; a copy of which oath, with a certificate of
the Justice of the Peace administering the same,
shall be entered upon the journal of the corporation.
SEC. 8. And he it (dieted, That the burgess and
commissioners so elected may meet from time to
time, and not less than once in every three months,
and the burgess shall preside at all meetings, and in
the case of tie shall give the casting vote, and in his
absence the assistant burgess shall preside, under
the same restrictions, but when the burgess is present
the assistant shall have the same power as a commis-
sioner.
SEC. 9. And be if enacted, That the said Burgess
and Commissioners, or a majority of them, may ap-
point a clerk and assign Ins duties and allow him
such compensation as they may think proper.
SEC. 10. And he if exacted, That the said clerk shall
enter all ordinances passed by the Burgess and Com-
missioners, in a hook to be kept by him for that pur-
pose, which book shall at all times be opened to the
inspection of all persons interested, and copies of all
ordinances shall be put up in the most public places
of said town.
SEC. 11. And be it enacted, That the said Burgess
and Commissioners may by ordinances direct all or
any of the footways in said town to be laid out,
leveled, mended, and repaired with any material they
shall think best, at the expense of the proprietors of
the different lots before which such leveling and
paving shall be done.
; SEC. 12. And he it enacted. That if any owner or
