empowered and directed to divide the public county
roads of said county, into suitable road districts, and
for each of said road districts, shall appoint a respon-
sible citizen of said county a supervisor thereof.
SEC. 2. And he it enacted. That all able-bodied male
citizens of said county between the ages of eighteen
and fifty years, shall be compelled to work on said
roads whenever they shall be ordered to do so by the
supervisor of his district, either by verbal or written
order; upon failure of any person owing such service !
to appear at the time ordered either in person or by
proxy, with such tools as the supervisor may desig-
nate, he shall stand indebted to the County Commis-
sioners in the sum of one dollar and fifty cents, to
be collected, as all common debts are collected, by
the supervisor, in the name of the County Commis-
sioners, and should the supervisor fail to bring suit
for the collection of said amount, he shall forfeit five
dollars of his salary as road supervisor, for each and'
every such failure.
SEC. 3. And be it enacted, That the commissioners
of said county are empower to designate how many
days each of said citizens shall work in any one year,,
and how many hours each day; the supervisor of each
road district shall enroll the names of all persons in
his district liable to road service, in a book kept for
that purpose; he shall also keep a separate list of
those who work when ordered, and a similar list of
such ay fail to obey his summons, which lists shall be
subject to the examination of any citizen of said
county, when desired.
SEC. 4. And be it enacted, That the supervisors may
use any dirt within three feet of either side of the
road for repairing such roads; prodded, there is no
ditch or sufficient drain passing the part needing
repairs; where such ditch or drain exists, the [the] dirt
shall be taken therefrom for the above purposes; in
repairing all roads, the supervisor shall have a care,
and be required to keep the roads smooth and eleva-
ted in the middle of same.
SEC. 5. And be it enacted, That whenever any ditch
or drain may be made upon the side of any road by
