any private enterprise, and the dirt thereof thrown
upon the road side of such ditch or drain, it shall be)
the duty of the supervisor to spread the same on the
roads, unless the party or parties placing it there
desire it for their own use, and will remove it in a
reasonable time.
SEC. 6. And be it enacted, That the supervisors shall
have the right to draw the water from the public
roads, into any private drain or ditch adjoining or
near said public road, and to cut a ditch or drain
across any private land or lands, by and with the
advice of the County Commissioners of said county,
for the above purpose.
SEC. 7. And be it enacted. That all new public roads
hereafter opened in Wicomico county, shall be made
thirty feet wide, well drained and graded, and it shall
be the duty of the County Commissioners to reject
all such roads, if not put in the most complete order,
and the County Commissioners of said county may
make at any time, further rules and regulations that
may be necessary for the better keeping of public
roads, not inconsistent with this Act.
SEC. 8. And, be it enacted, That the supervisors of
said county, shall upon receiving their appointment,
give to the commissioners, their bond, with good
and sufficient security in the sum of one hundred and
fifty dollars, for the faithful performance of their duty,
and upon failing to keep the roads in good condition,
shall be liable to presentment to the Grand Jury for
neglect of duty.
SEC. 9. And be it enacted, That the Act shall take
effect from the date of its passage.
