endorse the bonds of the Worcester and Somerset
Railroad Company, to the amount of five thousand'
dollars.
SEC. 2. And be It enacted. That the Town Com-
missioners of said town, shall appoint two persons to
act as judges, to receive and count the ballots cast
at said election, and the said judges shall return the
ballots and records thereof, to the Clerk of the Cir-
cuit Court of Worcester county, to be kept by him,
and upon such ballots shall be printed or written
the words "For Endorsement," or "Against Endorse-
ment," and if it he found that a majority of the
votes cast shall he in favor of endorsement, then the
Town Commissioners of Newton, are hereby author-
ized and required to endorse the bonds aforesaid, to.
the amount of five thousand dollars, and when said'
bonds become due, if they are not paid by said rail-
road company, then the Town Commissioners of
Newtown shall levy a tax upon the property of said,
town sufficient to pay the same.
SEC. 3. And be it enacted, That the said railroad
company shall pay the interest on the bonds endorsed
according to the provisions of tills Act, semi-annually,.
but should they fail so to do, then the Town Com-
missioners aforesaid shall levy annually a tax upon
the property of said town sufficient to pay the same.
SEC. 4. And be it enacted. That tills Act shall take-
effect from the date of its passage.
