CHAPTER 158.
AN ACT to repeal sections one hundred and thirty-
nine and hundred and forty-one of article seven of
the Code of Public Local Laws of Carroll county,
entitled " 'New Windsor," and to re-enact the same
with amendments and sub-sections.
SECTION 1. Be it enacted by the General Assembly of
Marl/kind, That sections one hundred and thirty-nine
and one hundred and forty-one of article seven of the
Code of Public Local Laws, entitled " Carroll coun-
ty," sub-title " New Windsor," he and are hereby
repealed, and that the following sections and sub-sec-
tions are hereby enacted in their stead:
SEC. 139. That the Burgess and Commissioners
may make and enforce all such by-laws, regulations
and ordinances, not contrary to law, as they may
deem wise, equitable and expedient, for the comfort,
health and convenience and prosperity of the town
and its inhabitants, for the prevention and removal
of nuisances, preservation of health, and suppression
of vice and immorality within its limits, and for such
purposes are empowered and directed to enter upon
any private grounds or premises as often as they may
deem necessary, to examine into the condition there-
of, and if not found in a satisfactory condition, to
adopt such means as may be necessary to remedy the
same.
SEC. 141. That all fines, penalties and forfeitures
imposed by the ordinances, imposed by the Burgess
and Commissioners of said town, shall be recovered
before the Burgess, or any Justice of the Peace of
Carroll county, upon a warrant issued to the Bailiff'
or any Constable of said county, and the said Bailiff
or Constable shall serve it under the same penalties
as in cases of summons for small debts from a Jus-
tice of the Peace, and receive the same fees, to be
paid by the corporation; and the person convicted,
in default of payment, may be committed to the jail
of Carroll county, or an appropriate place of confine-
ment within the corporation, provided by the Bur-
