and be of the opinion, that the money drawn for is duo to the
party drawing for the same, under and by virtue of any such
contract as aforesaid.
SEC. 10. And be it enacted, That the Commissioners ap-
pointed by this Act, or a majority of them, shall sell and
dispose of such material, as shall not be wanted or used, in
erecting the building aforesaid, remaining of the Court House
destroyed by fire as aforesaid, and the proceeds arising there-
from shall be appropriated towards building the said Court
House.
Sec. 11. And be it enacted, That if any of the Commission-
ers appointed by this Act, shall die or remove from Wash-
ington county before the completion of the aforesaid build-
ing, or refuse to serve, or resign, then the remaining Com-
missioners are hereby empowered to fill all such vacancies ;
and that in all matters under consideration respecting the
duties imposed by this Act, upon the Commissioners ap-
pointed by this Act, the will of a majority shall prevail and
determine everything they may at any time have under consideration in the performance of their duties.
Sec. 12. And be it enacted, That the" County Commission-
ers aforesaid, shall have the bonds as aforesaid, printed,
and shall pay tor the said printing, out of the funds appro-
priated to the building of the said Court House, all their
necessary and legitimate expenses incurred in the discharge
of their duties, imposed by this Act ; and that the compen-
sation beyond actual expenses, shall not exceed one hundred
dollars for each of said Commissioners.
Sec. 13. And be it enacted. That all that part of sec-
tion 1, of Article XXVIII., of the Code of Public Gen-
eral Laws, by which the County Commissioners have charge
of and control over the property owned by the county, BO far
as the same applies to Washington county, and is inconsist-
ent with this Act, be and the same is hereby repealed, until
the Court House, to be erected under the provisions of this
Act, is completed.
Sec. 14. And be it enacted. That this Act shall take ef-
fect from the date of its passage.

The further consideration of said bill was postponed until
to-morrow, 6th inst., at 12 o'clock.
On motion by Mr. Stephenson,
Leave was granted to Messrs. Stephenson, Fields and
Claggett, to introduce a bill entitled an Act to protect the
class of small birds, known as Insectivorous Birds, in Har-
