they may deem right and proper, and refund the money
thus borrowed, and interest, out of the proceeds of the
aforesaid bonds when sold.
Sue. 6. And be it enacted, That Josiah F. Smith, George
W. Harris, David H. Wiles, Benjamin A. Garlinger, Jacob
A. Miller, and John Heyser, of Washington County,
be, and they are hereby appointed Commissioners, with
full power and authority to contract, for and super-
. intend the building of a Court House, with all the ne-
cessary offices, upon the grounds owned, by Washington
county, whereon the Court House recently destroyed by fire
stood, and furnishing the said Court House and offices, when
so constructed, with all the necessary cases and furniture for
the accommodation of the Courts to be held in the building
for said county, members of the bar and public officers, and
with such other things as may be required.
SEC. 7. And be it enacted, That the Commissioners ap-
pointed by this Act shall use their judgment and sound dis-
cretion in procuring and adopting a suitable and correct plan
for said Court House, offices and necessary furniture lor the
same, having a due regard for the objects and purposes for
which the said building is required for the, use of said county,
and that the sum of money contracted to be paid for the
building and furnishing said Court House and office, shall
not exceed the sum of seventy-five thousand dollars.
SEC. 8. And be it enacted, That the Commissioners ap-
pointed by this Act shall take from every person or persons
who may contract for the building of said Court House and
offices, or furnish material for the same, or any part thereof,
good and sufficient bonds, with approved security in the
name of the County Commissioners of sail county, condi-
tional for the faithful performance of their contracts; upon
which bond or bonds an action shall lie by said County Com-
missioners to recover such damages, if any, that said county
may sustain in the premises by a non-performance of any of
said contracts.
SEC. 9. And be it enacted, That all persons having per- "
formed work and labor in and upon said building; furnished
material or furniture for the same, or any part thereof, pre-
paring or drawing a plan for said building, under and by
virtue of a contract entered into with the Commissioners ap-
pointed by this Act, tor all moneys -due, shall draw his or
their draft on the County Commissioners for Washington
County, for the money thus due, which draft or drafts shall
be countersigned by the Commissioners appointed by this
Act, or a majority of them. Provided, the Commissioners so
required to countersign, or a majority of them, shall believe
