322 JOURNAL OF PROCEEDINGS [Mar. 1, tion to Article XXX. of the Code of Public General Laws, relating to Crimes and Punishments, sub-heading "Embez- zling Property and Writings," Was read, considered and postponed. The Senate bill, entitled an Act to repeal section 135 of Article X\CIII. of the Code of Public General Laws, title "Testamentary Law," so as to make the Code conform to the Act of 1868, Was read the second time and ordered to be engrossed for a third reading. The Senate bill, entitled an Act to amend the Act of 1853, chapter 88, entitled an Act to incorporate the Pittsburgh and Connellsville Railroad Company, in the State of Maryland, by changing the name of the said Company to the name of the Pittsburgh, Washington and Baltimore Railroad Com- pany. Being upon its third reading, Mr. Stephenson (by unanimous consent) submitted the fol- lowing amendment: Add at end of section 3 Provided, That the rights, privileges and franchises herein granted to the said Pittsburgh, Washington and Baltimore Railroad Company are granted on the express condition, viz., that all its property, real and personal, including its rolling machinery, lying within the limits of the State of Maryland, and covered or embraced under the name of the Pittsburgh., Washington and Baltimore Railroad Company, shall be liable to taxation for State and county purposes, in in the same manner and at the same rates that all other real and personal property in this State are or may be taxed; and if said Pittsburgh, Washington and Baltimore Railroad Company shall appropriate to its use or uses, or exercise or enjoy any of the rights, privileges, or franchises, granted by this Act, such appropriation, use, or uses, exercise, or enjoy- ment shall be deemed and taken as the assent of said Pitts- burgh, Washington and Baltimore Railroad Company to the right of the State of Maryland to tax, as aforesaid, the said property of the said Pittsburgh, Washington and Baltimore Railroad Company, any provision in its charter, or charters, or any other law, to the contrary notwithstanding.
