So the amendment was rejected.

Mr. Gorman submitted the following amendment:

AMENDMENT PROPOSED.

SEC. 9. And be it enacted, That the capital stock of the
said Baltimore and Potomac Railroad Company shall be ex-
empt from the imposition of any tax on burthen, but the
said Company shall pay into the Treasury of this State, on the
first Monday of January and July, in each and every year
after it shall have commenced the transportation of passengers
from Baltimore to Washington, one-fifth part of the whole
amount which may be received for the transportation of pas-
sengers between Baltimore and Washington, or on or over
its railroad between Baltimore and Washington during the
six months preceding ; and it shall be the duty of the Presi-
dent of the said Baltimore and Potomac Railroad Company
to exhibit an oath or affirmation to the General Assembly,

at each session thereof, and within one week after it shall
convene, an account showing the gross amount received by
said Company for the transportation of passengers on said
road, and the State's proportion thereof up to the period of
time to which payments had been last made into the Trea-
sury of the State as aforesaid.

Which was read.

Mr. Bowlus moved that the House do now take a recess
until 7 1/2 o'clock, P. M.

Decided in the negative.

The question then recurring upon the adoption of the
amendment submitted by Mr. Gorman,

Mr. Wootton demanded the previous question.

The qnestion then being, "shall the previous question be

now put,"

It was decided in the affirmative.
