LAWS OF MARYLAND.

 

WHEREAS, It hath been shown by actual survey
and measurement, and substantiated by the affi-
davits of certain citizens of Cecil and Harford
Counties, of good standing and repute, that the
said Boom Company have violated their corporate
powers and franchises by building and erecting
piers of wood and stone, and by erecting their
main boom and auxiliary booms at forbidden points
on the Susquehanna River, by crossing and ob-
structing divers channels thereof, and by prevent-
ing the exercise of the common right to use the
public waters of the State, and preventing ingress
to and egress from public landings on the said
river, therefore,

Repealed.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That so much of the Act entitled An
Act to Incorporate the Cecil and Harford Counties
Boom Company, passed January Session, eighteen
hundred and sixty-seven, Chapter one hundred
and ninety-five, as empowers the said Company to
condemn land and fisheries, and to place piers and
other obstructions in fisheries below the head of
sloop navigation, be and the same is hereby re-
pealed.

Remove ob-
structions.

Sec. 2. And be it enacted, That the Cecil and
Harford Counties Boom Company, incorporated
under the aforesaid Act, are hereby directed and
required to remove all piers, booms and other ob-
structions placed by them in the Susquehanna
River below the head of sloop navigation, in vio-
lation of the aforesaid Act of Incorporation.

Limit,

Sec. 3. And be it enacted, That unless the pro-
visions of the second Section of this Act shall be
complied with by the first day of October, eighteen
hundred and seventy, then the aforesaid Act of
Incorporation shall be vacated, null and void.

Enter pro-

ceedings.

Sec. 4. And be it enacted, That in case the pro-
visions of this Act are not complied with by the
first of October, eighteen hundred and seventy, as
hereinbefore provided, then the prosecuting attor-
neys of Cecil and Harford Counties shall institute
proceedings forthwith against the Cecil and Har-
ford Counties Boom Company, and cause the said
Company to comply with the requirements, condi-
tions and provisions of this Act.
