way, at or near the Belvidere bridge, in the said
city, to tide-water at Canton, with as many sets of
tracks as may be deemed necessary, not exceeding

 

sixty-six feet in width, for the graded surface of
said road, and if said Company shall select any
one of the points above mentioned for the western
terminus of its road, it shall not be precluded from
afterwards selecting either or both of the other
points as such terminus, and the said President
and Directors, or a majority of them, may cause a
contract or contracts to be made between the said
Company and any person or persons for the con-
struction of the whole or any part of said road
and works, and the said Company, or its agents,
may enter upon, acquire and use any lands and
materials required for the construction and repair
of said road, and its necessary and convenient
buildings and equipments.

Sec. 10. And be it enacted, That the time-table
and rates of charges for tolls and freight shall be
under the sole control and management of the
President and Directors of said Company, or a
majority of them, but all railroad companies shall
have the right, upon equal terms, to run their lo-

comotives and cars over the tracks of the said
Company, and no discrimination in rates of toll,
or in any other respect, shall ever be made in favor
of any company; provided, that the said Union
Railroad Company shall not charge for the use of
the road a sum exceeding the rate of five cents per
ton per mile for tolls for use of said road for every
mile or proportionate part of a mile, and for pas-
sengers a sum not exceeding the rate of ten cents
per passenger per mile, or proportionate part of a
mile for each passenger.

Sec. 3. And be it enacted, That all subscribers to
the capital stock of said Company, having become
such prior to the passage of this Act, shall be at
liberty to refuse to accede to the provisions of this
Act, and upon notice in writing of such refusal
to accede to the same given to the President of
the Union Railroad Company of Baltimore, such
