for one mile, when the distance traveled is more
than half a mile; provided, that nothing herein
contained shall prevent said Company commuting
for toll by the week, month or year.

Sec. 8. And be it enacted, That if any person
shall wilfully break or throw down any gate on
said road, or dig up or spoil any part of said road,
or obstruct any culvert, water way or side ditches
upon said road, or forcibly or fraudulently pass
any gate thereon without first having paid toll,
for each offence shall forfeit to the said Company,

recoverable before a Justice of the Peace for this
State as other small debts are collected, the sum
of twenty dollars, in addition to the damages re-
sulting from his wrongful act.

Sec. 9. And be it enacted, That the stockhold-
ers of said Company, in general meeting assembled,
or a majority of them, shall have power to make
and adopt such by-laws, rules and regulations for
the direction and management of said Company
as may in their judgment be necessary for the pur-
poses of their incorporation not inconsistent with
the provisions of this charter, and the laws and
Constitution of this State; and the President and
Directors of said Company, or a majority of them,

shall constitute, appoint and employ such officers,
agents and servants for the construction, repair
and preservation of said road, and for the receipt
and collection of tolls, and transacting all other
business of said Company, as in their judgment
may be necessary.

Sec. 10. And be it enacted, That every person
who, to avoid the payment of the legal toll, shall
with his or her team, carriage or horse, turn out
of said road, or pass any gate thereon, on ground
adjacent thereto, and again enter on said road, or
wilfully misrepresents the distance he or she has
or intends to travel on said road, shall for each

offence forfeit the sum of five dollars to the said
Company, recoverable as is provided in the eighth
section of this Act.

Sec. 11. And be it enacted, That the said Com-
pany he and they are hereby authorized to make
branches to said road not exceeding five miles in
length for each or any branch; and that in regard
to each and every branch so provided to be made,
