Sec. 2. And be it enacted, That this Act shall
take effect from the date of its passage.

CHAPTER 5.

 

AN ACT entitled a supplement to an Act passed
by the General Assembly of Maryland at Janu-
ary Session, eighteen hundred and sixty-eight,
chapter four hundred and twenty-four, entitled
"An Act to incorporate the town of Berlin,
Worcester County."

 

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the Commissioners of Berlin,
or a majority of them, may open, close, straighten,
or widen streets across or through any yard, or-
chard or garden, within the corporate limits of the
town of Berlin, Worcester County.

Power of
commissioners

Sec. 2. And be it enacted, That the said Com-
missioners, or a majority of them, before they pro-
ceed to open, widen, or straighten any street,
shall appoint three disinterested citizens of said
town of Berlin, owners of real estate therein, to
be examiners, who shall give notice of the time,
place and purpose of their appointment, by setting
up a notice thereof, at three public places in said
town, at least ten days before the time of their
meeting, and that said examiners shall lay off said
street according to instructions given them by the
said Commissioners of Berlin, and shall value the
damages done to each owner of property injured
by the opening, straightening, or widening said
street, and shall make to the said Commissioners
of Berlin a return in writing of their assessment
of damages, and shall make out and return a plat
of the street as laid out by them.

to condemn.

Sec. 3. And be it enacted, That the Commission-
ers of Berlin, or a majority of them, may ratify
or reject the report of the examiners making a re-
turn of the damages assessed by them.
