Mr. Miller introduced the following
JOINT RESOLUTION. Resolved by the General Assembly of Maryland, That
Messrs. John Lee Carroll, William M. Merrick and John B.
Brown be and they are hereby appointed a Committee to as-
certain the amount of indebtedness of the Baltimore and Ohio
Railroad Company to the State of Maryland, and in making
such ascertainment, the said Committee shall investigate and
consider all items of indebtedness by said Railroad Company
to the State of Maryland, and shall also investigate and con-
sider any claim which the said Railroad Company has or
asserts against the said State, and that said Committee have
power to employ an accountant to assist them in said investi-
gation, and send for persons and papers; and immediately
upon the said ascertainment being made, the said Committee
shall file the same with the Comptroller of the Treasury, and
shall furnish the President of the said Railroad Company
with a copy thereof, and if the said Company shall fail to
pay the said amounts into the Treasury for the space of thir-
ty days after a copy of said ascertainment shall be furnished
said Company through its President as aforesaid, the Gover-
nor be and he is hereby requested to institute proper legal
proceedings' to enforce the payment of said amounts. Which was read the first time.
On motion by Mr. Carroll, The Senate proceeded to the consideration of the House
Joint Resolutions in reference to the claim of the State against
the Baltimore and Ohio Railroad Company. The question being upon the adoption of the unfavorable
report of the Committee on Finance, Mr. Stephenson moved that the report of the Committee on
Finance on said Resolutions be recommitted to the Commit-
tee on Finance, and called for the yeas and nays. On the question being put,
