Present at roll call, the following Senators : Messrs. President, Browne, Clarke, Denson, Earle, Fields,
Henkle, Jump, Maddox, Malone, Miller, Sellman, Snyder,
Spates, Stephenson, Timmons, Welch, Wilson—18. The Journal of yesterday was read and approved. The President laid before the Senate the following commu-
nication from the Comptroller in response to an order of the
Senate: COMPTROLLER'S OFFICE, Annapolis, March 9,1870.
Hon. Barnes Compton,
President of the Senate: DEAR SIR : In compliance with the following order passed
the Senate on the 8th instant to wit: " Ordered, That the Comptroller report to the Senate how,
and to what extent, the Free School Fund of the State will
be affected by the failure of the Baltimore and Ohio Railroad
Company to pay to the State the share of the proceeds of the
Washington Branch Road"—1 respectfully report that by
chapter 33, of Acts of 1839, the sum of thirty-four thousand
and sixty-nine dollars and thirty-six cents of the revenue
from the Baltimore and Washington Railroad is annually
transferred to the credit of the Free School Fund, in lieu of a
like sum of the State's share of the surplus revenue of the
United States placed to the credit of said Fund by chapter
285, of 1837. The revenue from the Baltimore and Wash-
ington Railroad, other than from the one-fifth tax on receipts
from passengers, amounts annually to the sum of fifty-five
thousand dollars, which is more than sufficient to save the
Free School Fund from loss, on this account, so long as the-
same is regularly paid.
