REPORT.

On counting the ballots of the Senators, it appearing that
25 ballots had been cast, when but 24 Senators had answered
to their names,

On motion of Mr. Clarke,

The roll of the Senate was again called, by the Secretary,
and each member approached the Clerk's desk and deposited
his ballot as his name was called.

The tellers then proceeded to count the ballots.

Upon counting the ballots, Mr. Malone, on the part of the
tellers, reported that there had been 24 votes cast upon the
part of the Senate, and 80 votes on the part of the House, of
which,

John W. Davis received.....................44 votes.
Samuel G. Miles " .....................14 "
James Pentland " ..................... 4 "
Wm. H.Owens " .....................6 "
Wm. H. Jillard " .....................13 "
Thos. W.Morse " .....................18 "
Wm. H. Hiss " .....................4 "
Geo. H. Steuart " ..................... 1 "

Number of votes cast ..................... 10

104 votes in all being cast, and that no person had received
a majority of all the votes cast.

On motion of Mr. Clarke,
The Joint Assembly then proceeded to another ballot.

Upon counting the ballot, Mr. Malone, on the part of the
tellers, reported that there had been 24 votes cast on the
part of the Senate, and 88 votes on the part of the House,
of which

John W.Davis received.....................54 votes.
Samuel G. Miles " .....................7 "
James Pentland " ..................... 0 "
W. H. Owens " .....................1 "
Wm. H. Jillard " ..................... 9 "
Thos. W. Morse " .....................32 "
Wm. H. Hiss " ..................... 1 "
George H. Stuart " ..................... 0 "

Number of votes cast....................... 104

Whereupon, it appearing that John W. Davis had received
a majority of all the votes cast, the Chairman declared John
