Article III, Section 36, of the Constitution of
Maryland. The amendment was ratified by refer-
endum on November 7, 1972, and accordingly
the Agency commenced operation on January 2,
1973, under the immediate supervision of a Direc-
tor, with the advice and recommendations of the
Commission.

The Commission consists of five members, all
of whom are appointed by the Governor with the
advice and consent of the Senate of Maryland for
specified terms. Members annually elect a
chairperson.

The Agency is under the immediate supervision
and direction of a Director appointed by the
Governor with the advice and consent of the Sen-
ate. The Director is aided by three Deputy Direc-
tors who are appointed by him.

From its Baltimore headquarters, the Agency
conducts statewide lottery operations for its
weekly and daily games. The Agency uses the
commercial banking system for distribution and
collection of the weekly game. This involves dis-
tributing tickets, retrieving unsold tickets, and
collecting payment. Lottery ticket sales outlets
are licensed retail establishments such as drug
stores, food stores, liquor stores, etc., and each
location can provide How-to-Play brochures and
other game information. Prizes may be claimed
through any of these sales outlets. Winning num-
bers are drawn on television each week.

On July 29, 1976, the Agency began a legal
pick-your-own three-digit daily lottery called
"The Numbers Game", which is similar to the
long-standing street game. Licensed sales outlets
sell and cash in daily lottery tickets through a
terminal connected to a computerized on-line
real-time system. Official winning numbers for
"The Numbers Game" are drawn on television
daily Monday through Saturday (Code 1957, Art.
88D).

The Maryland-National Capital Park and Plan-
ning Commission has Jurisdiction over parks and
planning in Montgomery and Prince George's
Counties. Created by acts of the Maryland Gen-
eral Assembly, the Commission exercises its au-
thority over all of the two counties except for cer-
tain incorporated municipalities.

The Commission is composed of ten members.
Five are residents of Montgomery County and
five of Prince George's. The five members from
each county make up that county's Planning
Board.

Within the Maryland-Washington Metropolitan
District the Commission is empowered to acquire,
develop, maintain, and operate parks systems
with recreational facilities, the expense of which,
including debt service, is paid from a separate
park tax levied within the district.

Within the Maryland-Washington Regional
District, the Commission is empowered to make,
adopt, and amend a General Plan for the Physi-
cal Development of the area, taking into account
all factors of urban, suburban, rural, and regional
planning. The Planning Boards make zoning rec-
ommendations to their respective County Coun-
cils, sitting as District Councils, for the portion
of the district within their County to enact the
zoning ordinances and change the zoning map.
The Planning Boards have exclusive responsibility
for subdivision approval, location and grades of
streets, location of public buildings and utilities,
